No idea about the local gun laws there.

Was he within his rights to defend himself with a gun in that situation?

everyone of those deranged morons running towards the armed retreating man is cannon fodder for a sensational headline. I wish that guy didn't show up but he did give his attacker exactly what he asked for.

I did Firearm Training & coaching when l got out of the Military ,on the bigger Nation wide training programs like FASTER Faculty/Administrator Safety Training and Emergency Response where l personally trained teachers,nurses & doctors etc from across the US as part of my commitment to the program ,when working on these type of America wide programs we would get basic run downs on the Self Defense laws for various regions .

From memory but don't quote me, NM has no clear definition like a Stand Your Ground Law,so vested interests will always try to blur the line between where justifiable and unjustifiable lies,but the New Mexico statute says that a homicide is justifiable in Self Defense when committed in defense of your own life, family or property, or when there is a reasonable belief that someone is going to commit a felony or greatly injure yourself or another person. I believe they also have a provision that states that a homicide is justifiable when committed to suppress a violent riot .

I have not seen a full video & now some are saying he initially brandished & that started the incident, so as with everything the facts will decide ,but from the video l seen where he was attacked, tried to retreat & shot to defend himself he will be cleared ,but people need to realize that can often still involve years of court battles & being bankrupted in the process.

As someone who served at the pointy end in Iraq & Afghanistan & then spent a couple of years as a Contractor, working in shit holes & hot spots before they hit the headlines,my advice is never pull a gun you do not have a clear legal reason to use ,never allow a attacker to get within reach of who you are protecting ,never stop pulling the trigger until the attacker is down & threat removed,never carry a gun for self defense unless you have proper training from a accredited reputable trainer ,not only so you know how to use it a real world threat & save your life ,but that bit of paper you get for successfully passing it may just save your ass in court .
