The shooter was: 1) running away from his assailant who was threatening him verbally and with a skateboard makeshift weapon; 2) as soon as he shot, he no longer perceived a threat and stopped, as evidenced by his crouching down and waiting till authorities showed up; and 3) he crouched so as to present as small a target and as submissive a posture to keep from further provoking his adversaries.
I honestly think the guy was trying to warn the initial attackers by saying "he's gonna fucking kill you" but since the scuffle was going on it sounds enough like "I'm/we're gonna fucking kill you" that it's quite possible the defender thought that's what was said.
This goes way beyond not charging the shooter with anything. If a bank robber's partner dies during the robbery, the bank robber is charged with murder. I want to see the guy holding the camera, the guy who said I'm going to kill you and the 2 people who attacked him all charged with murder.
