He already bashed the guy with his skateboard, not even from the front but from behind. The guy was already drawing from the other two people on him, he gets up, gets bashed from behind with a skateboard, turns around immediately and shoots.
Doesn't matter what he had in his hand at that point. He attacked. He got shot in self defense.
What the attacker did with that skateboard and what the people were telling him and the other two already having him on the ground was sufficient cause for him to use deadly force.
