This is actually brilliant. If you fire them and they go to the courts, a precedent will be set, one way or another. They are damned if the do and damned if they don't challenge it in court.
If the court rules that political affiliation is not protected, then the status quo is in effect, only now the gun points in both directions. If the court rules that political affiliation is protected, then the shunning of conservatives can be stopped...through the courts, no new law needed.
I'm glad you're doing that because letting employees get away with being snowflakes is no way to improve morale or promote a good work ethic. Where I work only a few take their work seriously, and the others somehow don't and nothing's done. Feels bad man.
