He was actually 'appointed' to fill a vacancy under 28 U.S. Code § 546...my problem is that section empowers the Attorney General to make the temporary appointment. It looks like 'someone' at the District Court decided to use subsection D to make a temporary 'appointment'.

I think 28 USC § 541, subsection (c) does still trump § 546 (d)

(c) Each United States attorney is subject to removal by the President.

so Barr potentially can't fire the guy, but GEOTUS sure can

Trump can lawfully delegate special authority to AG Barr to accept the 'resignation' of SDNY Attorney Geoffrey Berman...

I'll bet you a Doughnut Berman 'implied' he'd resign and then pulled this switch to force GEOTUS to fire him just to set up another Clown Show for Pelosi and her attack Penguin Nadler...

Most likely he was sworn in by a judge, but stated he was appointed by a judge because he had an attack of the vapors.
