Before the point that Kramer is being beaten up, doesn't it seem more like a Jerry scene? The interactions with the lady at the table and the people on the walk are much more like the sorts of situations Jerry gets into. Kramer is even acting more like Jerry than Kramer. He's relaxed and aloof and he casually swats away people's absurdity with a little quip or two.
I wouldn't be surprised if this scene was originally intended to involve Jerry but the producers cautioned against it because it might make it look like Jerry Seinfeld himself was making a statement against the AIDS nazis
