I've really been wondering about what comes next after the dismissal? The baddies have been so desperate to stop this dismissal that they've gone to unprecedented and clearly untenable places in their effort to stop it. I wonder if Durham's moves will finally start once Flynn has been dismissed? I'm not a legal professional but I was wondering if there's maybe some sort of evidence link between the two instances of justice?

Obama had 4 -oppression marks, making him more eligible then someone that cures cancer.

Obama may have got the prize for being the first muslim Foreign invader, to start taking down the US successfully after 911 failed.

-4
Belleoffreedom -4 points ago +19 / -23

It would be hard to get a conviction, and it would be terrible precedent (even if the asshole Democrats did it) to go after a former President.

At Obama's level, it is all policy directives, not direct actions. I am fairly sure he's smart enough not to leave evidence of a direction to commit a crime.

55
PROCIsAsshoe 55 points ago +55 / -0

I used to feel the same way but this is the first time we've seen an administration truly try to prevent the peaceful transition of power. I'm not expecting them to be able to produce evidence against Soetero as he is quite slippery and insulated by several lower-levels in the chain but I don't for one second believe that Dems would be so conciliatory towards a Republican if the situation were reversed. This was/is sedition by the 'constitutional law professor'.

So there will be no need to go after former presidents.

In his case, he was not eligible to be president -- it was a scam. A hoax.

Therefore, it is okay to go after him.

11
TheReal45 11 points ago +13 / -2

Very sane comment.

11
Kaarous 11 points ago +11 / -0

The precedent basically already exists thanks to Aaron Burr. He was the Vice President at one point, but he betrayed the nation and tried to steal Texas, then was outlawed here and fled to Europe.

4
CuomoisaMassMurderer 4 points ago +4 / -0

How did he plan on bringing TX with him to Europe? There'd be an extra baggage charge on the plane for that!

4
Kaarous 4 points ago +4 / -0

Remember that godawful Will Smith version of Wild Wild West? It was exactly like that, except without the giant mechanical spider. That's what Aaron Burr actually planned to do, steal Texas with a militia and a legal loophole, then sell it off to the enemies of the United States.

4
And_n 4 points ago +4 / -0

Lets be realistic. This happened 100 years before planes were invented.

67
Emper 67 points ago +67 / -0

The most important consequence of this is that Flynn now can file suit for wrongful prosecution. If he lost he wouldn't have been able. This could open discovery against everything the DOJ and FBI did. The DOJ now has lost control of the outcome and greater injustices can be exposed without Barr or some BS IG.

Isn't Durham already investigating this?

9
Tomm 9 points ago +9 / -0

Supposedly. It’s too early to tell if he is investigating this or just running out the clock like Huber was.

3
RocketSurgeon22 3 points ago +3 / -0

Durham is a whole different animal. Huber is a raccoon and Durham is a lion. According to their history. I hope it does not turn out to be a nothing burger.

-2
LeftistsAreInsane -2 points ago +0 / -2

There may be some sort of prosecutorial immunity, sadly.

33
PosterIsDead 33 points ago +33 / -0

And as this occurs, still more Brady materials, disclosures from the DOJ to Flynn's defense, which should have been produced years ago. But Sullivan allowed the trial to continue, didn't balk at Prosecution not producing reams of documents the defense knew existed, transcript of call that was not produced for Flynn's defense, original 302 not produced - no problem for Judge Sullivan, even though BOTH were central to the case for prosecution and defense.

Former_RM2 4 points ago +4 / -0

Yeah, I was wondering what would happen if he declares the appeals court judgment to be political in nature and therefor invalid, and then he decides to ignore it. Seriously, what happens then? He's not going to be impeached with this House, or Senate.

1
Stationhollow 1 point ago +1 / -0

He won't need to. The DC Circuit Court has 11 Democrat appointees and only 4 Republican. We lucked out with this 3 judge panel having 2 Republican appointees and only 1 Democrat but all it takes is the Democrats to request an en banc rehearing to reverse the decision.

1
Former_RM2 1 point ago +1 / -0

Is En Banc on the table for, what amounts to, an administrative hearing? This isn't really a verdict so much as it is an order, correct?

40
PROCIsAsshoe 40 points ago +40 / -0

Maybe that's part of why they've resisted dismissal so hard? You raise an interesting thought and I definitely agree with you. Those who would wield the law as a weapon for injustice should ultimately suffer its wrath.

10
AlohaSnackbar 10 points ago +10 / -0

"under color of law" is a phrase for a reason. THIS is the reason

8
RocketSurgeon22 8 points ago +8 / -0

The D.C. Establishment lost a critical case. It opens up discovery that will expose everything. They had to fight because they are all guilty. Judges, politicians, media, city/state leadership and law enforcement.

6
Tallsie 6 points ago +6 / -0

Remember folks, for the democrats, using our judicial process to hurt you financially and waste years of your time is the punishment. They don’t care if you are found guilty or not, they will have already broken you by the time it’s all said and done.

And yet, it IS done. Wheels of justice turn slowly, wheels of INjustice apparently turn even more slowly. We have been patient, can't imagine how much General Flynn's patience has been tested. And his family's. There's no way he's going to disappear into obscurity after something like this.

21

2

5
TedCruzAteABoogaloo 5 points ago +5 / -0

And even if you read the lone dissent in this decision, the Obama appointed judge said that Sullivan was not given ample opportunity to review all facts of the case and make a decision...

after 4 fucking years.

4
StaryHickory 4 points ago +4 / -0

Not only that Flynn was influential which saved him. For any rank and file citizen this would be a prison sentence. This is why these things are so important. None of us can depend on the DOJ helping us if they set us up in a similar fashion.

A decision like this must immediately be followed up by reforms to ensure it never happens again.

40

I'd be the same way, and I certainly hope General Flynn is too.

But after being put through hell for three years by the government of the country he served for over 30 years, I wouldn't blame Flynn if he just wanted to be done.

2
CuomoisaMassMurderer 2 points ago +2 / -0

Doesn't he need to win some lawsuits just to be able to afford to live?

39
kono_hito_wa 39 points ago +41 / -2

Judge Robert Wilkins, an Obama appointee, dissented from the decision, saying he would grant Sullivan the space to explore the DOJ's request for dismissal.

So the judge needs "space to explore" the prosecution's request for a dismissal? More like Obama appointee judge knows Sullivan's theatrics are bullshit but can't come right out and say it.

14
dahdahdah_dahditdah 14 points ago +14 / -0

This is the judge who during the mandamus hearing was reframing everything in terms of hypothetical racial injustice, even though that had nothing to do with the case. It's a Democrat who shapes the law to fit the outcome he wants, like the rest of the Democrats. What's disturbing is that his ilk is frequently in the majority.

12
Mrsattorney 12 points ago +12 / -0

Well, he needs space to explore so he can arrive at his truth, his reality, lol.

12

Must have been 2-1 vote with Wilkins the Soetoro lover dissenting.

After listening to the oral arguments, lots of people including myself thought Rao would be the dissent, and the court would allow Sullivan to do whatever he wanted.

What a sad time we live in that a single instance of the court upholding the law is a surprise.

7
Yucky 7 points ago +7 / -0

Rao came through. She was a Trump appointee (formerly head of OIRA).

Keep in mind though, this decision can be appealed by Sullivan if he wants. Perhaps he wants to just be done with it, but I'm sure there are thousands of lawfare leftist subverters pushing him to appeal.

3
IncredibleMrE1 3 points ago +3 / -0

What I meant was, I thought Henderson would vote with Wilkins to let Sullivan keep being an ass, and Rao would dissent. I didn't expect Henderson to side with Rao and say Sullivan needs to follow the law. Never doubted Rao.

[This case is about] whether, after the government has explained why a prosecution is no longer in the public interest, the district judge may prolong the prosecution by appointing an amicus, encouraging public participation, and probing the government’s motives. On that, both the Constitution and cases are clear: he may not. For the foregoing reasons, we grant Flynn’s petition for a writ of mandamus in part and direct the district court to grant the government’s Rule 48(a) motion to dismiss. In light of that grant, we vacate the district court’s order appointing an amicus as moot. . . . So ordered.

Make no mistake about this, this is a tiny part of a bigger picture. They're stalling for time at every level because the election is coming up, if they can manage to take it into overtime they have a chance. If they don't, they're absolutely fucked. This will continue to unravel slowly, which makes me wonder when the obstruction of investigation charges start to roll in for Obamagate. As far as I can see, they're having their way.

Judge: "I will not be bullied into doing my job! I am hereby invoking some mundane rule which I misinterpreted on purpose and I will be filing suit against the appeals court and hiring additional counsel!"

Why would crooked judge give up now?

Hahahaha. Our system finally. Finally, worked.

CuomoisaMassMurderer 1 point ago +1 / -0

No. This still has opportunity to go south. Which they will avail themselves of, hoping to stall for time and steal every seat via fraud.

Hahahahahahah excellent

Anything is possible with Sullivan. He's gone rogue. I was concerned that he would try to get en banc review since this was a decision by a 3 judge panel.

3
XiamenGuy 3 points ago +3 / -0

He can, but he's making himself look terrible for his future cases and loss of respect by the judiciary when they shut him down again.

2
Mrsattorney 2 points ago +2 / -0

Agreed, but I think he's almost past the point of no return. There's something very odd about his recent behavior.

2
CuomoisaMassMurderer 2 points ago +2 / -0

En banc review is my prediction. Stall for time, try to drag it out past the election, they hope to steal every seat by fraud. Then this kangaroo conviction happens to every one of us.

This is their plan. There's never been a bigger neon sign. I'd be very curious to see an accurate flowchart of just how pivotal this one case is in the big picture. I don't know how the system works well enough to know, but I've seen knowledgeable people claim this is the lynch pin. It seems to me there are plenty of other places for Obamagate to be proven, and this is more about one man; Flynn, who is a tremendous asset for us.

Mrsattorney 2 points ago +2 / -0

I think all of the other cases will fall (fruit of the poisonous tree). They lacked probable cause to be investigating all of these people.

1
CuomoisaMassMurderer 1 point ago +1 / -0

Ok, so the cases against our side fall?

What about the cases against the coup / Obamagate? That's what I've heard Flynn described as the lynch pin to all of it.

They dismissed it because more evidence was coming out against the DEEP STATE. They are in a lose lose situation. Release Flynn? Or incriminate the Deep State more. KAG 2020.

Shit for brains Sullivan! What's with LibTard judges, they use lying fake ruling logic that a 5 year old wouldn't feel comfortable using on their parents. Just goes to show even morons and retards can elevate to high status.

If you think this is over, you might want to slow down a bit. You underestimate how big of a asshole Sullivan is.

Now the Coupsters will appeal for en banc hearing

They're gonna drag it all the way to the SCOTUS.

6
BackWoodsBarbie02 6 points ago +6 / -0

Now look into Sullivan’s. Past. His son ... what they do. Who they are associated with.

Why is it necessary to look any farther than Strzok is his neighbor and they've been friends for decades?
