Correct. Sullivan does not appear to have any right to seek review en banc or before the Supreme Court. Imagine if every time you beat a trial judge on an appeal or a writ, he decided "fuck you, I'm going to get even" and tried to challenge the appellate court with his own further appeal/writ.
Imagine that the prosecution drops their case against an innocent man, but the judge decides to play god and keep the man a prisoner and find his own prosecutor to lay charges?
