Man, if only he swatted away the hand of s police officer, than the officer would be charged with assault.

These "public servants" can fuck right off. Think they are our superiors, when they are our employees.

But isn't assault of a judge, assault in the second degree under the Texas code? Still it's completely overcharged as a felony. Obvious coronavirus kabuki.

Another part of the Texas statute requires that "the actor is presumed to have known the person assaulted was a public servant, a security officer, or emergency services personnel if the person was wearing a distinctive uniform or badge indicating the person's employment as a public servant or status as a security officer or emergency services personnel". By analogy it's must have been clear that at the time of the alleged assault that the customer knew that a random strange person holding a business card was a judge and not possibly just another random crank. The report says that the card was swatted away. So it seems that it was not read at all.

I just don't see how any prosecutor would be able to prove this. Was the honorable judge wearing one of those "black robe" face masks?

A prosecutor who grossly overcharges to "send a message" is just as dangerous to the community as a prosecutor who refuses to follow the law and refuses to charge certain types of cases according to his/her personal whim.
