The Constitution explains the appointment of justices, and mentions the existence of a chief justice, but is silent on how the chief justice should be selected from the justices. Roberts was just appointed chief because he replaced the former chief Rehnquist per tradition. Trump could just come out tomorrow and assign a new chief and there's really nothing to stop him, other than the confusion it might generate.
I would like to select Clarence Thomas as the new Chief Judge of the Supreme Court as this would be a HUGE upgrade as the chief judge can select the cases that can be heard for the Supreme Court per each time they are in session. This would be beautiful payback to the deep state, JOE BIDEN (Creepy Joe) and BOTH Party establishments. I have hoped for this entire term President Trump would make this happen before the second term begins.
But he’s a rapist. See how easy those mental gymnastics are? Leftists don’t care about logic. Leftists that care about/figure out logic stop being leftists and become conservatives.
Kavanaugh and Gorsuch unfortunately would like to back stab our beloved President it seems then to ever vote conservative on major cases that would truly MAGA. I feel awful for DJT who has tried his best and instead of getting help, Gorsuch has been a disaster when we have needed him the most.
The chief Justice should be Thomas. In fact all justices should be justice Thomas plus one Alito. Fuck the rest of them including Kav and especially Gorsuch.
You are correct, there is no mention of the mechanism of appointment. So Pelosi can appoint chief justice as well, or, any congresscritter/senator. In fact, a reasonable argument could be made that the Speaker has more authority to appoint than does the president since the only mention of the chief justice is as it relates to running a trial of impeachment articles against a president.
You are correct, something needs to be done, however this isn't that something.
Defendants don't appoint their judges. Given that the ONLY mention of a chief justice is in relation to the trying of the president, the conclusion that he gets to select who that is is preposterous. The absolute closest you could get is the vacancy of the chief justice being filled when an impeachment trial is likely/imminent, and in that case we're all throwing darts at a board, because there are only arguments AGAINST the president (the accused), the speaker(the prosecutor), the majority leader (jury foreman), and majority vote in house(grand jury) or Senate(jury). At THAT point, it would have to be decided among the still present justices who to designate the chief justice.
But the one thing we can DEFINITELY say is that if the president can exert his power over the current chief justice, then there is nothing stopping Congress from doing likewise. And, in that situation we've got a problem.
Good news! There is absolutely nothing stopping a president from working WITH Congress to change who the chief justice is.
Possibly, Congress and the President could pass a law that specifies how the chief justice is selected. Short of that, the Supreme Court is going to keep following the Supreme Court's own rules.
Maybe, MAYBE, the President could nominate a sitting justice as chief justice and get the Senate to confirm. That gets murky, and it is unclear from the text if that would qualify. It is even less clear if the Supreme Court would accept it - and would the current Chief Justice and the nominated new Chief Justice both have to sit out that vote?
... and he shall nominate, and by and with the Advice and Consent of the Senate, shall appoint ... Judges of the supreme Court, and all other Officers of the United States, whose Appointments are not herein otherwise provided for, and which shall be established by Law;
"Democrats immediately expressed dismay at the course chosen by the administration, saying striking down the law would cost up to 20 million Americans their insurance in the middle of a pandemic."
Insurance companies do not pay for virus epidemics, this is why legislators passed a bill to give billions to hospitals.
Fun fact: insurance companies also to not pay for damages to business caused by riots.
I suppose that to a certain way of thinking, Insurance companies could be described as for-profit socialism.
Big on promises of protection and security but hit or miss on the actual delivery. And usually a complete failure when, not if, reality exceeds beaurocratic imagination.
Individual Mandate was the unconstitutional part that GEOTUS stopped with an Executive Order. EO's are supposed to expire if not proposed as law by the usual process through the houses.
I don't think he can, though, because the whole reason he used to get it through was that the mandate was a tax. That is gone. I'm pretty sure Trump timed this to be right before the election because he is going to win this time. :) He wouldn't gamble on this if he didn't already know the outcome.
Salaries and benefits of administrators and doctors plus insurance & pharmaceutical salesman commissions and insurance & pharmaceutical companies profits, and their lobbiests for Congresspersons
Hospitals service ought to be like airlines and fast food - inexpensive.
For that amount of money you can fly to a nice foreign country, stay at a nice hotel, go out partying and have an MRI done in the private sector without insurance every month.
Younger generation is completely oblivious to how good it was. My first job was in 2003. Fast food. Full benefits, 401k match, overtime available, 40 hour weeks. That kind of shit is the holy grail for fresh college grads now. It's nuts.
In 2008-2010, I was barely 20 and paid 30 a month health insurance at a very large company. With low copay, low deductible, great.
Then I remember the first enrollment period after Obamacare was finalized (sometime near 2011, a year or two later) my plan shot through the roof unexpectedly, and my deductible shot to 6500...
I have had to go on and off health insurance since then depending on what rates I can get with my employers, but haven't had anything close to what in had before, neither in coverage or price.
Best I had in price was essentially a emergency plan that had an 8500 deductible, basically no coverage, and it was still over $100 a month.
Man, that sounds so familiar to my situation. Right out of college got a job, and the first year I'm there is when Obamacare rolled out and it became too expensive for my workplace to offer decent insurance. So I was stuck going on the healthcare marketplace where I had to pay 450+ dollars for some bronze, the absolute minimal coverage. Plus at the time, no one knew what the penalty for not having health insurance would be so I felt pressured to purchase the insurance in fear of being fined.
I would hop on that, i had to pay the fee for 2 years at least, since I was too poor to afford healthcare post obamacare, but not poor enough to get free Obamacare, so I had to pay for others healthcare and get none for myself cause that makes sense!
So will that also repeal California's version of Obamacare? Starting this tax year season, they now require people to have insurance else they will be "fined" as well.
I remember hearing that Trump can remove DACA by executive order since it was illegally created via illegal executive ORDER. Guess he wants the courts to admit it first.
Oh I know it.. looking forward to the mental gymnastics now that the olympics are postponed this year. It should be entertaining what Roberts comes up with.
Had BC/BS for 30 years. It was 700 a month after retirement... bad enough. Next year was 1100 a month, and the next year, 2100 a fucking month for us two! So for the first time, we went without healthcare insurance. Glad Chief Justice Robert's is ok with it, tho.
Fuck obama and fuck the democrats that forced it down America's throat. Fucking goblins indeed...
Fun fact: high level gummint employees like preezy, congress, and scotus (all the assholes who forced this shit on Americans) are all exempt from 0bamacare .. they have their own cadillac plans .. that you and I get to pay for with our tax dollars.
I think she's only alive in a technical sense. It's a reasonable assumption that her clerks are doing her job and they just wheel her in from time to time in order to keep up appearances
It's gotta be a sad state for her. Most people when they get that age can say to themselves that they've had a good life and are ready to go. She can't say that. She has to stay alive to defeat the orange man bad and keep their spot so she can not be at peace with herself.
This. I agree. Without a ready to go, better alternative ( that would stand no passage in an election year), this would completely sink the President's chance of reelection.
Anyone that doesn't believe this is delusional. I too, agree with your hellish description of Obamacare. It needs to go into the dustbin. But without some other viable alternative, in the middle of a pandemic with mass layoffs, this political kryptonite. I live in a "Trump state", and if you want to see it go to the Democrats, this is a sure fire way to do it.
Timing in life is everything, and this IS NOT the right issue at this time, no matter what I may personally think of that piece of crap law.
When the Supreme Court upheld Obamacare i lost all faith in the system. Maybe someday that faith will be restored but that was a seminal moment in American history.
People wanting Medicare for all and not holding themselves to account to be healthy are the same people blaming police for every guy who tries to fight the police because he doesn't want to be arrested.
Insurance used to be so good...as a Type 1 Diabetic, I can't get anything through insurance now, even the top tier insurance I had from a hospital and the state, they completely wrote off DME and needed a doctor note and labs with an A1C >10 instead of helping people get their A1c from 7.5 to 6.5...
Medicaid and Medicare people can because it is corrupt and has no fiscal responsibility..
Disagree, much as I would like to see it. By “respecting state’s rights” and allowing it to happen, Trump is providing a stark contrast and an uncensored exhibition of what the Democrat’s America would be like. He secures more votes this way (for himself AND both chambers of Congress), and crucially earns a mandate after reelection to clean Antifa’s clock. If he shuts them down hard now, it only helps “muh resistance.”
As it is, our Supreme Court is a fucking clown show. Fuck John Roberts
Trump needs to disrupt tradition and consider reselecting who the chief justice is, just to put Roberts on blast
The Constitution explains the appointment of justices, and mentions the existence of a chief justice, but is silent on how the chief justice should be selected from the justices. Roberts was just appointed chief because he replaced the former chief Rehnquist per tradition. This would be beautiful payback to the deep state, JOE BIDEN (Creepy Joe) and BOTH Party establishments. I have hoped for this entire term President Trump would make this happen before the second term begins.
This would be an extremely nimble navigator move. Especially during all this BLM shit. Let the mental gymnastics gold medal competition begin.
But he’s a rapist. See how easy those mental gymnastics are? Leftists don’t care about logic. Leftists that care about/figure out logic stop being leftists and become conservatives.
Rapist.
The best the establishment could try to invent with him was “is there a pubic hair on my Coca-Cola?”
Black lives matter.... just not this particular black life that ruins our narrative.
Trump needs to see this. Your idea is brilliant.
Interesting ramifications there. The Chief Justice appoints judges to and oversees the FISC. Roberts clearly is not an active supervisor.
Thomas needs to be chief justice, absolutely.
Thomas is a great choice, but I would like to see it go to Kavanaugh for the extra reeees.
Kavanaugh and Gorsuch unfortunately would like to back stab our beloved President it seems then to ever vote conservative on major cases that would truly MAGA. I feel awful for DJT who has tried his best and instead of getting help, Gorsuch has been a disaster when we have needed him the most.

Congress doesn't appoint Justices.
Even if Roberts wasn’t Chief Justice, he’d still be the swing vote.
Possibly, Congress and the President could pass a law that specifies how the chief justice is selected. Short of that, the Supreme Court is going to keep following the Supreme Court's own rules.

That would be fucking hilarious, but what would it change exactly?
Roberts is still a traitor who bends the knee to the left on the most important issues of our time.
Which is oddly something I've accused Trump of a couple times in the past, but I'll take anything that fights back against the left at this point.
Muh FISA
I hope he is executed. Fucking traitor
(This is not a call to violence. The punishment for treason is death however)
*treason.
I would hope there would be no punishment for reason, especially not death...
The "punishment" for reason is the death of ignorance. Not a bad thing at all. ;)
Fixed
:)
Talking of rop3 for this very purpose got me banned on reddit tD
I can respect your sentiment, but you sound like a reddit loser.
Maybe

Roberts is on notice. This should be interesting. Does the Chief Justice admit he was wrong??
Not stinking likely....
No. They will uphold obummercare
I don't think he can, though, because the whole reason he used to get it through was that the mandate was a tax. That is gone. I'm pretty sure Trump timed this to be right before the election because he is going to win this time. :) He wouldn't gamble on this if he didn't already know the outcome.
This man is bold....
Yes please!! Maybe I can afford my company health insurance after this.
No kidding. At my previous company, we had premiums as high as $280, for people in their 20's! Needless to say many did not enroll.
"I can't retire because my premiums are $500 and once I retire the company stops paying their $1400/mo so my premiums become $1900/mo. "
What are we even paying for?
Other ppls free healthcare
Useless shitbags’ free healthcare.
FTFY
Salaries and benefits of administrators and doctors plus insurance & pharmaceutical salesman commissions and insurance & pharmaceutical companies profits, and their lobbiests for Congresspersons
Hospitals service ought to be like airlines and fast food - inexpensive.
I’m sick of the healthcare debate being who pays for it, it should be why is it so fucking expensive
For that amount of money you can fly to a nice foreign country, stay at a nice hotel, go out partying and have an MRI done in the private sector without insurance every month.
The person in question has never left the USA, nor will they ever. Country boys stick around family.
280 a year ain't bad, oh nvm
Younger generation is completely oblivious to how good it was. My first job was in 2003. Fast food. Full benefits, 401k match, overtime available, 40 hour weeks. That kind of shit is the holy grail for fresh college grads now. It's nuts.

I should have specified, it's per month.
Yeah I know, I was trying to make a jokey joke.
Mine was 280... Per pay!! 26 times a year and because of the Cadillac rule only covered 80 percent after deductible!!! Sucks
Cadillac Tax is/was unfair too.
scotus is the legislative branch now, no way they get rid of it
And unelected no less.
There should be a class action against Obama, personally, for everyone that had to pay the unconstitutional mandate.
I would hop on that, i had to pay the fee for 2 years at least, since I was too poor to afford healthcare post obamacare, but not poor enough to get free Obamacare, so I had to pay for others healthcare and get none for myself cause that makes sense!
I want every penny back with interest.
I just want him tried for his crimes. I wouldn’t give two shits about Obamacare and it’s hassles if we could have this one thing.
And Hillary, while we’re at it. Why stop with one evil piece-of-shit traitor?
So will that also repeal California's version of Obamacare? Starting this tax year season, they now require people to have insurance else they will be "fined" as well.
California gets what it voted for.
I remember hearing that Trump can remove DACA by executive order since it was illegally created via illegal executive ORDER. Guess he wants the courts to admit it first.
All I know is everything if EFFed up now. Make the rules as you go along.
If they didn’t do it in 2012, I don’t see any reason they would do it now.
There's no mandate now, which was the entire reason the Supreme Court declared it a tax.
Oh I know it.. looking forward to the mental gymnastics now that the olympics are postponed this year. It should be entertaining what Roberts comes up with.
The reason is orange man bad.

Pretty cool, huh?
Yup, exactly. You have to admire the democrat shitheels and how brazenly they steal from us and fuck us over when they have the power to do so.
Roberts! Get ready to defend your crappy Obamacare decisions, butt-munch!
How the fuck is RBG still alive? This may backfire on us.
At least that's the way I see it.
"Unfathomable cruelty." DIAF Pelosi
Good luck with that. With 'conservative' judges like these, who the hell needs flaming libs?
This. I agree. Without a ready to go, better alternative ( that would stand no passage in an election year), this would completely sink the President's chance of reelection.

Timing in life is everything, and this IS NOT the right issue at this time, no matter what I may personally think of that piece of crap law.
Wasnt it the SCOTUS that enshrined it in the first place? Doubt anything will change.
My choices have definitely been limited
At first I could pick decent plans, not anymore
And the cost still goes up
Not that I don’t agree with this idea, but why bother right now? Roberts and RBG will fuck everything over somehow, guaranteed
When the Supreme Court upheld Obamacare i lost all faith in the system. Maybe someday that faith will be restored but that was a seminal moment in American history.
The entire law violates the commerce clause and the 10th amendment.
Unconstitutional law.
John Roberts is compromised
Every single member of Congress that voted for this 2000 page pile of steaming Unconstitutional garbage should be removed for malfeasance.
LET’S FUCKING GO!!!!!!!!!!!
Obamacare is fascism. Govt forcing private insurance companies to do their bidding. Doctors will commit suicide more.
It's communism - redistributing peoples' wealth to those who refuse to work.
People wanting Medicare for all and not holding themselves to account to be healthy are the same people blaming police for every guy who tries to fight the police because he doesn't want to be arrested.

Anyone have suggested reading to help those of us less informed about the affordable care act understand it and explain it to others?
I don’t have much faith in on of the justices. Justice Roberts
It will be overturned because it is unconstitutional.
John McCain is down in hell making sure the Devil doesn't forget John Roberts sold his soul.
Even though Trump got 2 appointments, the next one is paramount.
This is the only way it can be replaced with a better option(s).
It's already invalid. It never passed. It was never voted on.
Roberts has already gotten on all fours to save the ACA. He'll do anything he can to do it again.
Trump is a honest man that deserves a good answer. So please look into his request.
With the mental gynmastics roberts used to justify it staying by calling it a "tax" (if I remember right) it needs to be looked at again.
Knowing the current court that wont even take it up.
Pelican brief anyone😂
I believe I am going to need to speak to a doctor in about 4 hours about my erection

You sound like a CNN analyst. The state one lives in has nothing to do with “knowing what you’re talking about.” Stop concern trolling.
Insurance companies are not going to just give up all their subscribers.
