Isnt failure to enforce a copyright on your content grounds for removal of the copyright? How many thousands of times has that image been shared with no takedown?

I don't exactly know copyright law as I'm not a lawyer so I'm afraid I can't answer that question. But i'd expect there to be some legal ramifications if it wasn't for the fact that NYT is on Twatter's side against Trump.

IANAL but it's my understanding that if someone makes a DMCA claim the ISP or platform has to take it down immediately. It's not their job to adjudicate it.

That being said, you don't give up your rights to an image just because you didn't make a claim against everyone who used it.

Whether the NYT's claim is valid is another story. It depends on whether Trump agreed to allow the photographer/NYT to retain rights to the image.

To my mind, the other images should also be removed, especially if the claim is about the image of Trump, not the text, but it would be up to the copyright holder to pursue it with Twitter, et al.
