Lol, does the Denver Post even have a case here? You publicly publish information, you can't use "copyright" laws to prevent people from knowing the information you publish.

Unless the police dept. was selling those pictures, no, there's no case.

A copyright literally gives you the right to decide how and when copies of your work are made. If someone uses your copyrighted work then you can sue them for statutory damages.

Copyrights exist to give creators a route to financially punish those whole steal their work.

If the newspaper really wants to stop the cops from using it then they would have to sue. They might need to file for a copyright which you can do for 3(?) months after publication.

But their case is weak and they know the cops could just get a warrant for the photo because it shows someone who is committing a crime. So they just resort to asking.

Technically yes. They own the license to the picture from the photographer who holds the actual copyright. If it is an exclusive license they have legal standing to sue the police to stop them from reproducing it.

It will be thrown out quicker than you can say "Arrest this Mexican" but they still have the legal right to attempt a lawsuit.

We shouldn't be critical because it's just like here. When someone posts a rare Pepe and asks politely "do not steal" we honor the request. So many rare Pepe's have gone through that I desperately wanted yet I respected the posters requests. If we didn't, the market for rare Pepe's would have the bottom of it fall out. Then we'd have no more rare Pepe's.
