Interstate compacts are extremely common man. Like, don't think this will be the defense.
Edit to clarify:
I really should have been more clear about this. That is on me for not adequately explaining what I mean here.
I'm not saying that they are allowed to legally make these interstate compacts, or that I pretend to be a legal expert on the subject.
I am just saying, and it disgusts me that this is the case, that it doesn't really matter what the law says or how clearly it is laid out in the constitution.
Not practically at least. Not when it comes to whether or not they will be able to get away with it.
The SCOTUS, especially this SCOTUS, has shown time and time again that it is much more interested in making political rulings, or rulings based on how they think things should be, than on making rulings based on how things were actually set up to be in the constitution (aka a legal ruling).
Is this ok? Fuck no, judicial activism is killing this country and the people's faith in our system. Do I think that because this law has been overlooked in the past that means your legal arguement is incorrect? Nope. Wouldn't dream of making that arguement.
What I am saying is that I don't trust the courts to make the correct decision based on this legal arguement. Not even a little.
Maybe it should be the defense. I guess I'm not legally informed enough to make that statement one way or another. I just worry that it won't be effective, not because of it's merits, but bc of the corruption of our system.
I think it would be a good idea to do everything we can to make sure we win the popular vote, and make this decision bite them in the ass worse than anything has ever bit anyone in the ass before. I think it we get the message out to conservatives living in totally blue or totally red states that normally stay home, that this time their vote is CRITICAL and that we need them to show up like never before, we could shock these scheming faggots and force them to vote Trump even when their state voted for Biden.
I think we need to do this starting now, because we simply can not rely on the courts to get it right.
Believe it or not, any interstate compact that has an effect on federal issues (NY/NJ port authority, for instance) has to be approved by Congress, or it is unconstitutional.

Congress is the house and the senate.
