So it’s okay if I drunk drive without a license as long as I promise I won’t crash into him? It’s okay if I steal as long as I don’t touch anyone? It’s okay if I build a house without a permit or license or any idea what I’m doing? It’s okay if I dump oil into a lake? There are so many other harms, and there are times when we appropriately prevent someone from doing something because it will lead to harm. Like prohibiting gun ownership of violent felons. Or prohibiting people from owning tanks or nuclear bombs. Or requiring licenses to drive and prohibiting drunk driving. Or prohibiting selling heroin. Prohibiting the sale of alcohol wouldn’t be different in kind from many thousands of other laws.
