The appellate court allowed this to happen when it didn't make their ruling effective immediately instead of the 21 day effective date.That let Sullivan run the clock for 3 more weeks and then ask for a full review at the last minute. This will be pushed past the election by using scheduling delays, oral arguments, filings, etc. Sidney Powell probably should have petitioned the court right after the ruling to ask them to make it effective immediately. She has been right on the money through all this so we'll see if this strategy pays off.
