He isnt incorrect though.... and that's the fault of Congress for not being more clear about it when they decided to turn promised tribal lands into a state, which is fine by me, but instead they decided to beat around the bush with their language so as to try not to owe anybody anything and in doing so they set this up to happen many years in the future....

Anyone whose case is dismissed because of this will definitely be tried in federal court though...

and I can just about tell you why this is going on, because state prison is almost always worse than federal prison... Federal prison, according to inmates, is literally a walk in the park in comparison as far as the quality of food, the quality of the building itself, usually having more TVs, playing cards, and what not. Those are stupid examples but I'm just trying to shed some light on the mentality of inmates in State versus fed.

Use some common sense when interpreting the rule of law.. that's supposed to be their job. "Well Congress never did anything to codify this in a hundred years so..." Duh, their lack of action is itself an action. They left it alone for a reason and this wasn't it. Also you can't tell me that nobody else has ever disputed the rule of tribal law over that section of the state before. This guy who raped a 4 year old was the only person ever to challenge that? Bullshit.

Gorsuch is a piece of crap and a bigger mistake than Jeff Sessions.
