Actually no, there’s an argument for fighting words, but the actual reason that that’s important is that it establishes what is known as “depraved mind” the thug just wanted to hurt someone for the sake of it. That looks worse come sentencing and in some jurisdictions it upgraded the charges.

Fair enough, but why the delay in charging in the interim? It was clearly a criminal act regardless.

So if someone called you a nazi, racist, or cracka ass cracka, would those be fighting words that would come into consideration for reduced punishment in sentencing?

Iirc, didn't they change the "fighting words" defense to make it actually reasonable?
