The issue is bullshit brandishing laws. Had the rifle been properly slung, or his wife's pistol holstered they would probably be ok. The legal theory in most places is basically that you better not have it in your hand unless your life is in such immediate danger that you have to fire to kill the threat.

Brandishing at people trespassing on their property. Thats some major bullshit. They should have refused to surrender their firearms. And the city is going to get its ass sued. But the Corrupt DA and Judge who signed off on this warrant are going to get off scott free. Makes me sick. This is EXACTLY the reason the 2nd A was written.

Yup. We were all busy fighting gun bans we missed these subtle rule changes. The idea behind them being to make using a firearm in self defense so dangerous that people wouldn't buy one. Truth be told if the couple in question hadn't brandished the mob would have attacked, forcing them to draw and fire. So ass backwards.

i am sick to my stomach over this...that it is happening, and that none of the local veterans/gun-owners/bikers for trump are standing for these people. all of these state government's are failing in their first responsibility to their citizens, but the citizens aren't doing much for themselves, either.

After listening to him on several interviews, I think he’s a based guy with a past just like Trump of supporting Dems on occasion. He’s also on record for calling out BLM as a Marxist political organization and doesn’t support them. If I recall one interview, he was a little shaky on this issue but has since changed his stance. Probably because now there’s nothing to be gained by pleading to them for acceptance. They want this couple destroyed.

Honest question: do judges normally issue search before charges have been filed? If not, wouldn't that mean a judge could issue a search warrant without probable cause to every home and all those found with contraband could retroactively be charged with crimes?

Yes. Search warrants often come before charges but can also come after as new information is learned. The issue here is they have to establish in the warrant affidavit that the evidence they seek is based on probable cause to believe that it was part of or used in commission of a crime. So if a crime was committed, why weren’t they arrested promptly? They don’t have a crime but found a corrupt judge to issue the warrant and shitty cops to serve it.

Amazing how much fortitude all of these urban cesspool's DAs have when it comes to pursuing any citizen that refuses to be brutalized by lawless ferals. Every dem urban hive has shown the same thing...no movement against mobs but immediate action response to anyone that fights back or defends themselves. Sickening that LEO would even entertain these type of harassment orders in cities where the DAs have made it clear that it's open season on LEO.
