Executive order = federal level. He did that because states weren't prosecuting and there needs to be a mechanism to charge people (if it didn't already exist).
Basically that means by default 85%. Prison terms simply don't last to the max time charged no matter what but Fed time is always harsher even if Fed prisons are supposed to be more lax.
A state charge is when the state brings charges on you. This is like 75% of crimes. Federal is typically when you violate federal property, cross state lines, or run into some kind of special law that is enforced at a federal level. Transporting drugs across state lines is one example. Weed may be legal in one state, not legal in another. Getting caught in the latter state with the drugs and provable have departed the previous state you could end up charged at a state level for the possession but at a federal for the transporting across state lines maybe.
Probation is only for people who violate the law at a county/state level in my experience. You end up on probation in a county or counties if you have not gone to prison or were jailed in country jail with a sentence of under 365 days. Sentences of over 365 days are prison terms and the person will be paroled after serving time. The only major difference between parole and probation in my experience is parole will not violate someone for marijuana while probation will.
You can get a felony and years in prison for transporting weed from one legal state to another, which is fucking insane. But that's because most of those states haven't really legalized it, they've YOKED it. In California there's something like a 40% tax on weed. In Washington you're only allowed to sell pre-packaged, sealed herbs with serialized packaging, also heavily taxed. Similar stories out of CO, not sure about everywhere else.
Right. Most people don't know shit about how the laws work. If someone asked me to drive a uhaul full of weed to CO I'd probably talk to a lawyer about if the scenario is legal.
Mmmmm not so sure bout that. Most people in prison that don't get into shooting meth or catch Hep C look way younger than their age because all they do is eat and exercise.
I'm only slightly more familiar than your average person but in my experience once you move beyond a traffic citation plea agreements are super common. Very few people take things to a jury trial and much more commonly there are a couple things on the table for a 'guilty' plea or a 'no contest' plea. guilty is acknowledging guilt, no contest means you will not contest the states charges. Typically guilty would be for something you are for sure going to go down for but you are saving prosecutors time in court by taking a plea for a slightly more favorable sentence. No contest is similar but you are not explicitly admitting to guilt simply that you accept the charges and sentence but again, will probably have negotiated something a bit more lenient.
People don't commonly take things to jury trial because you either get off or you get the maximum sentence.
Tidbit of info: a common charge for a felony is known as 16/2/3 16 months, 2 years, or 3 years. That is for the same charge. Each of those can be assigned based on the plea agreement or if you take it to trial it could be a 3 year sentence. 16 months would be like first offense, 2 might be if there are additional charges, 3 would be like a career criminal getting charged again (maybe). Pleading out would make this all flexible.
Congratulations, a**hole. I hope the next time you go for a job interview, AFTER you get out of Federal prison, the hiring manager looks at you and says: "Hey, you look familiar. Didn't I see you in the news"?

TFW you know you're headed out for at least 10 yrs of being prison bitch...hahahaha. That asshoe's expression is priceless!!!!
Federal crimes are 85% of sentence. State is 50% (CA) so more like 8.5 years tops assuming he doesn't plea out somehow.
That depends on the wording of POTUS' executive order, right? I haven't read it in this case.

IANAL though and probably not totally correct.
Federal crimes do not come with probation. No probation for any federally convicted crimes.

No parole in federal system.

Calif should be exhibit A on how not to legalize something.
With all their BS restrictions and taxes they have managed to legalize something while not really making a dent in the black market for pot.
I would appreciate if those who downvoted this would take the time to share your thoughts with me. I don't understand you, but I want to.
In prison a 5 year sentence can age you 20 years.
Mmmmm not so sure bout that. Most people in prison that don't get into shooting meth or catch Hep C look way younger than their age because all they do is eat and exercise.
If he gets written up for fucking up in the federal pen they won't take off any good boy tendie time. I imagine Cali state pen is different.
I'm not versed on the inner-workings of our judicial system. If the prosecutor has a good case, would they offer a plea deal?
