Summary: • Section 242 of Title 18 makes it a crime for a person acting under color of any law to willfully deprive a person of a right or privilege protected by the Constitution or laws of the United States. Subject: direct personal life threatening state civil rights health violations & discrimination complaint.

Hello, I am vetanon, a homeless disabled combat veteran of the Oregon Air Guard (ONE/OEF).

I am disabled, both mentally and physically, from service connected disabilities I obtained in Iraq.

I have difficulty breathing. I have Allergies. I have Asthma. I have Gulf War Syndrome from the burn pits in Iraq that compound the above. I have a rare skin condition that makes me allergic to the sun. I have learning disabilities. I have PTSD from combat in Iraq, and near death experiences from breathing attacks.

I can not describe to you what it is like to lose control of my mind and body as my nose clogs up and my lungs close up and I am unable to breath normally as my vision fades away from me and I can no longer even feel my own limbs.

This has put me in the ER several times.

As I mentioned above, I am also photosensitive, as in, I'm allergic to the sun. I can not 'just' stand outside to conduct business, without endangering my health.

Additionally, because of my mental disabilities it is hard to hold any of the information in my head as your associates rattle everything on the shelf off. I need to look at the available product.

The ragweed and pollen counts are of the charts this time of year. Standing outside too long also puts me into respiratory distress. I had to leave, I could not complete the transaction under the restrictions put on me.

Because of your agency I am bullied every time I walk into an establishment, and demands are put on me that I put my life into mortal danger.

I can not even use the bathroom or buy food in most of Washington & Oregon now.

I cannot survive on fast food drive through junk, it is literally making me ill, but no one else in the state wants to sell to me. Because of your guidance I am assaulted when I walk through the door. I am being yelled at and threatened for trying to stand up for my right to eat and live, like everyone else.

The official Washington & Oregon guidelines as well as medical professionals and CDC policy, as well as my own doctor tell me not to wear a mask, as well as for others not to try to force one onto me. However the state's implementation (as opposed to the way the counties handled it), does not make clear to businesses the health exemptions, and it is not being enforced at all. I have been unable to work because of this and now the department of commerce has had to reassign me to the labor pool and hold me with no hours because of the risk to my life from your implementation of these policies! I am a field worker and work and live in the public.

What kind of reasonable accommodation is it to tell me to go off into the woods with no work and starve to death? There aren't any other options left to me!

I have already tried working directly with the businesses, and counties but am continually informed this is all beyond their control. I tried the covid hotline all day but just got hung up on when they eventually called me back.

Additionally I feel the following laws are relevant to my situation.

RCW 70.84.070 Penalty for violations. Any person or persons, firm or corporation, or the agent of any person or persons, firm or corporation, who denies or interferes with admittance to or enjoyment of the public facilities enumerated in RCW 70.84.010, or otherwise interferes with the rights of a totally or partially blind, hearing impaired, or otherwise physically disabled person as set forth in RCW 70.84.010 shall be guilty of a misdemeanor.

RCW 70.84.010 Declaration—Policy. *** CHANGE IN 2020 *** (SEE 2390.SL) *** The legislature declares: (1) It is the policy of this state to encourage and enable the blind, the visually handicapped, the hearing impaired, and the otherwise physically disabled to participate fully in the social and economic life of the state, and to engage in remunerative employment. (2) As citizens, the blind, the visually handicapped, the hearing impaired, and the otherwise physically disabled have the same rights as the able-bodied to the full and free use of the streets, highways, walkways, public buildings, public facilities, and other public places.
