The 4th amendment protects individuals from unlawful search and seizure unless the government has probable cause.
Participating in a riot and an insurgency is a crime. And this creates probable cause for an arrest.
Here is the text of the the 4th Amendment:
“The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.”
Being arrested by a federal marshal is not a violation of your 5th amendment rights. You still have a right to trial whether you are arrested by a state, local, or federal official.

“...nor shall any person be subject for the same offense to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation.”
I want to point out that the NDAA that Barack Obama put in place allows detention without cause or trial and it has not expired. The champion of the left is the one who set the base for what is happening to Portland anarchists.
