I was wondering about that exception. Since the main point of a brandishing law is the idea that you are threatening someone with lethal force. Your victim doesn't know the gun is inoperable. As NoStumpyTrumpy mentioned, it's equivalent to assault, just like saying, "I will kill you."

Also, how many jurisdictions have exceptions in their brandishing laws for self defense. Which this case certainly is.

Hell I want these guys as my attorneys if I ever get charged with anything. My attorneys better be doing everything in their power to help me beat the case. Just like the McCloskey's attorney did for them in this case. Theres literally no way to prove when that firing pin was switched around🤣 The smart ass lawyers knew that. As dumb as it is that they are even having to fight this case.

Why does this matter? If she had pulled the trigger and put a bullet in one of the rioters she'd still be in the right. It's castle doctrine, you don't have to retreat off your own property in MO and can use deadly force to protect your life and property.

I will say...that’s bad gun etiquette, the way she was handling it. Even if she knew the gun was inoperable. Even if I know my gun isn’t loaded and has no round in the chamber, I still treat it as if it’s loaded.

With that said, those punks shouldn’t have been there to begin with.
