I think that was just sheer luck. I saw a DUI flee from police, and wreck/roll his truck. Splattered his passenger on the pavement behind the truck. The cop rolls up, gets out.. Driver tries to pull himself out the top side of truck, which is the driver side because its sitting like that, and cop pulls out gun, without aiming down sights, and bang, right through the drivers neck.
He radioed "driver is refusing to exit vehicle". I was raging when I saw that, but after learning more about how people can actaully be so hyped on adrenaline they can fail to feel the gun go off or hear it go off, I thought it was just a "too perfect" failure of the cop on his part. Not really his fault he got a kill shot accidentally. Think it was a glock too, so that standard heavy trigger pull unless he modded it. And maybe thats how he adrenaline dumped the one in the chamber.
Anyway, what Im saying is a cop at night pulls out a gun, and without aiming down the sights but aiming gun in general direction of vehicle, clips a guy's fucking spine, paralyzing him. Thorough analysis of video leads me to believe it was just pure luck.
you're right. That would be negligent discharge in case of any incident where you weren't at any physical risk. And thus manslaughter or aggravated homicide or whatever. The job of DA is to win. The job of your lawyer is to win. In court people have to present their best case, so the DA does not try to be fair. They try their hardest to make you look like a monster. The job of your lawyer is to try their hardest to make you look like a saint.
