Kagan reminds me of Breyer - definitely hard left but she's not as abusive of her office as some of her peers. I honestly get the feeling that she just interprets the Constitution differently and genuinely believes that the Founding Fathers would have sided with her if placed in the current climate and context on the case. Don't get me wrong, I think she is absolutely wrong and is 100% incorrect in her interpretation, but the point is that she's not casting her vote because she personally wants it that way, she's casting it because her ass-backwards thinking has made it where she believes that that's correct interpretation. Doesn't mean that she should hold her current office or that we should forgive her decisions, just means that she's likely not doing it out of pure selfish intent to push her will on the people.
Sotomayor is a whole different story and I thoroughly believe that she views the Court as a nine person legislature. I'm shocked that Republicans haven't tried to remove her. I'd be surprised if she even considers the Constitution when making her decision, she's absolutely casting her vote purely out of what she personally thinks would be the best policy. (Come on people, there's literally a recording of her happily saying that the 10th Circuit is the real place laws are made.)
