If he’s around when Roberts leaves, he can be nominated by the President. Unlikely with the age imbalance in the wrong direction, but Kavanaugh maybe.

Because he filled the Chief Justice seat. When Roberts goes, his replacement will be Chief Justice. The other seats are Associates and they don’t shift unless the President selects a seated Associate to nominate to the open Chief Slot. Then he nominates a new Associate to back fill of the Senate confirms.

That's not true. The president has the option to appoint a newcomer or any sitting associate as Chief Justice, but he doesn't have to. There is also no confirmation process for the position like there is at the lower levels.

You really should read the entire thing I wrote.

He can appoint anyone, and did. Only few times did a president select a seated associate for the spot.

And yes, the Associate WOULD and HAS gone to the senate for confirmation for the Chief seat. The job has more responsibility to the country, leadership on writing court opinions, and a higher pay.

Three incumbent associate justices have been nominated by the president and confirmed by the Senate as chief justice: Edward Douglass White in 1910, Harlan Fiske Stone in 1941, and William Rehnquist in 1986. A fourth, Abe Fortas, was nominated to the position in 1968, but was not confirmed.

So if the executive branch doesn't like the reasoning of the Court, it can just ignore them by this logic.

If judging how internal decisions are made, rather than judging the actions is whats important, than the executive branch should be able to question the motives of the judges before accepting their rulings.

In the interest of truth and not becoming the fake news which we hate, I would like to indicate the article does not mention Ted Cruz calling for John Roberts's resignation, like the post title mentions, only Tom Cotton doing so. I found Ted Cruz saying some criticisms of Justice Roberts, but I didn't see anywhere where he called for his resignation.
