I feel like car insurance is the one and only insurance that isn't a scam.
I've been in two at fault accidents in my life. First one when I was about 20. I slammed into a median wall and the car was totaled. My out of pocket was my deductible of $500. That was all I paid. No injuries. Not even a scratch or a bruise. My insurance did go up, but not as much as you may think, like 20% and it slowly dropped off every year until like 25. I just got a new car like a week later when the insurance check came in.
About 8 years later I rear end someone. All I paid was my $1,000 deductible. I got my car fixed, and I never even heard about what happened to the guy I hit. My insurance didn't even go up.
It would not surprise me in the least if insurance claims were denied. If the police did not do their due diligence, which is what insurers base their rates upon, then why pay a claim where police officers did not show up?

Where I used to live it's the opposite -- a commercial unit on the ground floor covers a lot of property tax and if they use parking spaces they even contribute money that is distributed monthly to all the owners. As long as there's a separate entrance for the residential units, and there is enough soundproofing, it can be a great arrangement.
The biggest problems in my experience are when it's a restaurant with distinctive smells; those end up floating around everywhere. But small shops that don't make noise are great.
The little liquor shop below me even gave gifts to the residents on occasion :)
