well that's easy enough to figure out, assuming nobody just grabbed the thing and ran off if they have the rifle as evidence they just check to see if 5 rounds are missing and do a quick and easy ballistic test to match the rounds fired with his rifle.
furthermore, even if (that's a big if) AK guy didn't fire and it was a secondary shooter, that's still a good shoot because there are pictures where AK guy has his rifle raised with his finger on the trigger and he's aiming at the driver. Eyewitness reports state he'd been doing this all night. If you're the driver and you hear someone firing rounds at you and another person is pointing a rifle at you with their finger on the trigger, there is no state in America where it is illegal to use deadly force on the person pointing a rifle at you.

You can hear about five shots, then a few seconds later about three other shots followed by a bang. The first set of shots sound different from the second set. The first set are from the AK, the second set is from a handgun. There is no way it was the other way around. The AK is NOT going to make a little firecracker style sounds next to a handgun.

As noted in another thread the AK dude is first to fire. Video audio supports this. (Someone says it was to shoot out the tires). Car driver responds in kind when he gets out of the car though I've read elsewhere that he just wound down his window to fire.
The police reports actually seem to be indicating they believe the AK guy never fired his gun and that there was another shooter. So possibly some other idiot fires his rifle, spooks the driver and the driver shoots AK guy. We will see I guess
well that's easy enough to figure out, assuming nobody just grabbed the thing and ran off if they have the rifle as evidence they just check to see if 5 rounds are missing and do a quick and easy ballistic test to match the rounds fired with his rifle.
furthermore, even if (that's a big if) AK guy didn't fire and it was a secondary shooter, that's still a good shoot because there are pictures where AK guy has his rifle raised with his finger on the trigger and he's aiming at the driver. Eyewitness reports state he'd been doing this all night. If you're the driver and you hear someone firing rounds at you and another person is pointing a rifle at you with their finger on the trigger, there is no state in America where it is illegal to use deadly force on the person pointing a rifle at you.
Oh for sure if that happens to be the case the guy still doesn't deserve to be charged but it adds an additional interesting element where another asshole with a gun got one of his buddies killed.
