Also nothing stops the Federal Government from using the principle of eminent domain to seize all the land around the courthouse needed to improve the security (this happen everywhere after 9/11 so they could install concrete barriers).
So keep pushing and I'm sure that will end up as a best way for the Feds to settle the fencing issue.
