I think you mean the DA. The headline is false - the state AG has requested the courts dismiss the case. He's been on the McCloskeys' side the whole time. He cannot drop charges, because his office didn't file them. The corrupt DA did.

No no, that's something else, probably a constitutional claim breach of 4th Amendment right against unreasonable search and seizure.

Malicious Prosecution is generally a tort claim against a prosecuting attorney who does not have probable cause or other reasonable grounds to bring a claim against defendant.

I'd send you a link but it looks like Minnesota Malicious Prosecution is a common law claim rather than statutory, thus looking at any Minnesota attorney's blog will give you the necessary info.

I read what the police did and I think either our side of the media lied to sell a conspiracy theory or the McCloskey's lawyer caught the police red-handed and prevented a farce.

The cops field-stripped the gun to make it operable but when it was presented it was inoperable.

The police didn't or at least did not yet claim that the pistol was operable at the time of the home defense.

I'm very firmly in the belief that the McCloskey'sknow what they're doing thus my speculating from info reported by third-hand sources (hearsay) seems moot.

Headline is false. The State AG cannot drop charges because his office is not the one who filed charges. The county prosecutor did. He is seeking dismissal of the case, ie, asking the court to dismiss it.

The mayor of St.Louis and Kim Gardner D.A. for St. Louis, brought charges against a local couple last month who were caught on video brandishing weapons on the porch of their mansion. She is the one who needs to be charged with at least tampering with evidence and removed from office. The Missouri AG and governor have defended the McCloskey's rights from the beginning!

At this point it's actually better to bring to trial, but if the judge hearing the case is worth a damn they're going to dismiss it at the first hearing as the statute specifically says that using a weapon in accordance with MO 563.031 is not brandishing. After the case is dismissed by a judge that's enough to file the tort claim.

The damage is already done. The second they confiscated the guns it was done. The entire reason they did this was to stop people from defending themselves. These people were rich as hell and as lawyers knew the law in and out. The message was to your average Joe who now understands if he sticks up for himself he'll be taking on the whole world. And he's going to hesitate. No matter how brave he's going to pause and realize "they're going to ruin my life. It would be so much easier to just go hide in the basement and pray they don't find me." And in that hesitation the left already got what it wanted.
