A couple days after the DOJ filed the motion to dismiss Flynn, the Obama audio complaining about that motion “leaked.” This was the Obama call to arms to the crooked Deep State (including Sullivan) to do everything in their power to maintain the prosecution against Flynn. They CANNOT allow Flynn to start talking about what he knows, particularly before the election. And they know that he is not free to speak until this case against him is dismissed. That's not quite how it works. The President doesn't have the power to remove Federal judges - Presidents nominate them, but Congress confirms them, and can only be removed by impeachment in Congress. It's part of the checks and balance against corruption in the Executive branch, and the Legislative. It's why it's in the Constitution. Neither Barr nor Trump can removed Article III judges. If they could, they'd wipe the slate clean when a new party and President moved into the Oval Office. Sullivan there for life, unless he retires or is impeached.

If Barr were smart, he would simply withdraw the petition right now so they don't hear it en banc, then proceed with the case, present only the exculpatory evidence, and rest their case.

The aim now should be to challenge everything, to keep them from trying to set a precedent that they can just prosecute cases by parties with zero legal authority nor interest. If we allow that precedent to be set, it will open the door to an insane level of abuse. It has to be nipped in the bud here and now.

Flynn was coerced into a guilty plea and had his family threatened with imprisonment by prosecutors who wantonly withheld exculpatory evidence over charges that should have never even been made in the first place per Strzok's own hand written 302's.

That actually hasn't been ruled on yet, I don't think. Flynn was waiting on the response to his request to change his plea, when Sullivan allowed the amicus brief filings, and Flynn filed the emergency writ of mandamus in reaction to it, which put everything up to that point on hold.
The insanity is, even if Sullivan allows him to change his plea - there's no prosecutor. Sullivan can't send the case to another court or district, every Article III judge would face the same lack of prosecutor.
The whole thing needs a flowchart and timeline to make sense of what happened, what hasn't happened, and who was involved at what point. Barr got rid of the Mueller shill Van Grack as prosecutor, and handed it to Shea, because Van Grack is accused of withholding Brady evidence. I recall reading that Powell, Flynn's lawyer, considered Sullivan to be her personal hero for upholding Brady rights in cases - and then threw that all out of the window for Flynn, and she was devastated to see what he was doing.
I have to wonder what ties Sullivan has, especially to Nation Of Islam, or actual Islam. Because Flynn was under fire immediately because he'd said "Fear of Islam is rational" on Twitter.

The number of votes here is the same as the number of votes required to reverse this, so this WILL go against Flynn, I'm sorry to say. The only bright spot is that it gives us new grounds to push for the recusal of Sullivan as mentioned by the feds in their brief.
You can ignore basically any sophistry you hear in oral argument. No, I don't care how harsh the questioning sounds, that doesn't mean a damn thing. They NEVER would have taken this to make work for themselves if they weren't planning to reverse it. Yes, maybe there's a 1% chance of someone changing their minds, but don't bet on that.
Expect the panel to be reversed and for this to get remanded to Sullivan because it was "too early" to tell Sullivan to shut up and go home. This should get appealed to the Supreme Court, there may also be further wrangling pushing for Sullivan to be recused.
At this point, I'm not sure the Supreme Court wouldn't just kick the can back to Sullivan in a 5-4, with fucking Roberts of course being the deciding vote.

The time for the Surpremes is probably if the en Banc hearing goes against the DOJ. This is a bizarre case to begin with - it's unprecedented for a judge to sue for relief in a case they're supposed to be trying, and the prosecutors want to drop the case for lack of evidence. Sullivan isn't technically breaking the rules, but it's pretty clear to everyone this is politically motivated...but the Surpremes can't decide a case like this on political grounds, it's if Sullivan is acting outside of the authority granted to him by the Constitution. Which he isn't, I think. And that's why Trump will pardon him, because slogging this whole case through the courts because a Clinton appointee judge has decided to be an asshole isn't worth the time and money.
I think what's even crazier here is that the original prosecutors intentionally and wantonly withheld exculpatory evidence and not a single person was reprimanded for doing so. Just that fact alone should have resulted in an immediate mistrial and dismissal with extreme prejudice with those prosecutors looking at possible disbarment. Yet, here we are in 2020 clown world.

The case was going to face en banc either way the appellate panel ruled. Sidney Powell would have requested it if the panel ruled against the writ of mandamus, and as we saw, Sullivan requested it after getting BTFO'd.

Instead of a 3 judge sub-panel of the district appeals court, all the judges of the district sit in and get to vote.
They all have to agree to hear it en banc, they then all sit before the case on its merits and then will individually rule.
And, it is a 7-3 court in favor of Democrats. It will be a political ruling. So much for justice.

This isn't about Flynn's sentencing. That's what Sullivan wants to get to. Flynn on paper is guilty, there was no trial because he plead guilty as part of the plea deal he struck with Meuller's office. Flynn wants to take back his plea, and plead not guilty, which would force a trial on the merits of the case, and the DOJ said they don't feel they'd get a conviction, so they asked to judge to drop the charges before sentencing occurs.
Sullivan has a hard on for putting Flynn in jail, going against the plea deal that was negotiated where Flynn would get probation and community service. If the en banc hearing goes for Sullivan, then the path is clear for him to proceed to sentencing, with the guilty plea in place, plea deal be damned. He's indicated that he's looking at 6 month minimum jail for Flynn. if Flynn prevails, Sullivan will have to allow the DOJ to drop the charges and it's over.

Yeah, but I think there are several appeal routes to take if the en banc hearing punts the case back to Sullivan. Or even before (correct me if I am wrong) - Flynn might appeal to the Supreme Court on the grounds that Sullivan had no standing to request the En Banc hearing, as he's not a party to the case. Failing that, I believe at that point there are still motions pending before Sullivan by the DOJ to dismiss the case, and also Flynn/Powell's motion to withdraw his guilty plea. If either of those motions are denied, they can be appealed. If he ends up sentenced, he can appeal. There's no end to the ways they can drag this out.

This judge was literally ordered to drop it by a higher court and just decides to do what he wants to do despite it being illegal.
So what happens now? The entire case restarts for Judge Sullivan or for a higher court? And who is the prosecutor if they want to drop the case?
Whenever an appeals court provides its order, it can be appealed another level up. In this particular case, as soon as Anus McAnusFace Sullivan began acting unlawful, Flynn's lawyer, Sidney Powell, filed a writ of mandamus motion with the appeals court.
A writ of mandamus in lawyer speak means do your fucking job, you are acting outside the bounds of what the law enables you to do. The 3 person appeals court (2 Trump appointees, 1 Obama) ruled in favor of Flynn's writ of mandamus motion. And so ordered Anus McAnusface to throw out the case.
But it appears Sullivan appealed the higher court again, asking what's known for an en banc hearing. That is a request for ALL the appeals circuit court judges to weigh in on the topic. Why every appeals court judge needs to weigh in is beyond me, but here we are.
And in my opinion, it's not good for Flynn. The en banc full appeals court is allegedly 7 Democrats, 3 Republican appointees.
Essentially, this circus will keep going on, probably until after the election or Trump pardoning Flynn.
The idea that a judges is deciding to prosecute someone and got told no then decides to appeal that too if retarded as fuck.
A judge is supposed to rule on a case or guide a case before a jury, NOT prosecute cases.
Should be a 10-0 appeal and the 'judge' should be jailed for being retarded, yet we know that won't happen (by retarded I mean corrupt as fuck).

I still don't get this: How can a judge appeal a ruling? Flynn didn't request the en banc hearing; the prosecutors didn't either. It's really none of Sullivan's business, right?
Edit: Wait a minute - on this order it says that Michael T. Flynn is the petitioner. How can that be? Is that in reference to the orginal Mandamus petition? Or the request for En Banc?
Probably the original mandamus. I am definitely not a lawyer, and therefore talking out of my ass in the prior post. I'm basically summarizing all the other articles I've read from other conservatives who are lawyers.
Flynn was the original petitioner for mandamus. The court granted the petition, but Sullivan requested En Banc. Flynn is still the petitioner as it is still he who filled the original petition.

Trump judge and 1 Bush judge rules in favor of Flynn so all they need is 2 Bush judges and the Clinton judge to join the people who already ruled in favor of Flynn and it's done.

I doubt they'll rule for Sullivan though as it is beyond ridiculous what precedent it sets. Any judge. Anywhere. In any case could DENY the prosecution and defendant withdrawing a case and forcing a court appointment of a prosecutor.
You then lose impartiality of the court, judge already proves he wants you sentenced and there is no presumption of innocence. You then have the court acting as executive branch by bringing it's own prosecution.
I do not believe these judges will be willing to have that travesty attached to their names.
What makes you think they care about impartiality of the court? This is about raw power and exterminating anyone in their way.
If you don't believe me, read how they plan to expand the # of judges across all federal courts, including the Supreme Court. They know they can't get rid of all the judges McConnell appointed, so they'll just outnumber the ones there.
As far as Flynn's case, they probably know they won't win the case, but are hoping to slow roll the process in the hopes that if Biden wins, they will lock Flynn away in jail. Or just looking to see how much they can get away with. I find that unlikely because even if Trump loses, I expect him to pardon Flynn before 2021.
Because it would create massive litigation problems and more lawsuits. Nothing judges like LESS than more work. So their laziness might actually save the nation from a ruling so retarded it breaks the entire system.

From what I understood, having an en banc (French for "in bench") for judicial issues of this type is very rare. According to some lawyers posting online, requesting an en banc for a case like Flynn's, let along for the en banc to be granted, is almost unheard of.
A quick dismissal is going to reach SCOTUS and become a political talking point. Honk yer noses, ye dirty scallywags, them perilous waters of 2020 have yet to subside.
