Crap.

There's literally no good reason to rehear this except to reverse it. We'll have to go to the Supreme Court at this rate.

Courts don't make busywork for themselves. They're probably going to end up remanding this.

The only variable I see is that they MAY have to recuse Sullivan now due to his appeal. The DoJ brought up some important hurdles for them and there are no good answers for them. Expect them to go clown world and simply ignore the points raised.

The longer it takes to resolve the case the longer Flynn’s gag order stays in effect. They are afraid of what he might say.

I think that was Stone who had the gag order. If there was one in the Flynn case, I missed it.

After looking into it more I am seeing conflicting reports, some say he is and others say he isn’t, meanwhile none of them provide source.

Well I wouldn't be surprised if it was linked to what documents could be declassified or something, but I'm not aware of a specific gag order on the docket. I suspect some people are just confused with Stone's case.

I don't think it would be the entire case. It should only be in regards as to whether DOJ can drop charges after Flynn pleaded guilty. The 3 judge panel ordered Judge Sullivan to allow it.
