This is Lawfare at its finest. Why no one in Sargon's circles thought of this is beyond me. It's not too late. If you used this platform and left when Saragon left, you can still help bring Patreon to its knees. But that would require confrontation which a lot of us don't like. We just want to be left alone. That is our weakness.

Short answer is that it depends on the TOS. Patreon's TOS is what fucked them.

Let me provide a bit more insight.

Patreon is based in California and has all of it's users agree under its TOS that all civil proceedings will occur under California Law. In California they have something called the JAMS statute which allows companies to enter into binding arbitration for certain civil cases instead of the court system. The law however states that under the JAMS statute the company must pay up front up to $10,000 (and it can go higher).

Now here is where Patreon fucked themselves. In their TOS they explicitly states that plaintiffs cannot bind together as a class. The JAMS arbitrators upheld this. So Patreon itself is preventing from all these arbitration from binding together as a class and instead there has to be an arbitration for EACH CASE.

So if you left Patreon prior to the TOS change you too can be a part of this.
