That is the smart play politically. It can hurt the legitimacy of the cases if it looks like it's just to influence an election.

The most important thing in prosecuting these political actors is that the public is generally supportive of it. It's not right, it shouldn't matter what the public thinks about any case, but it is the reality.

It's part of the reason there is effectively a "two tiered" justice system...because of the public itself.
