Uber and Lyft can get fucked if they think they can dictate a 'no weapons' clause in my own vehicle.

There's nothing to "get". Violating employee guidelines is not illegal, at most they fire him which is pretty much expected at this point

Uber and Lyft is different.

You can decide to work, or don't. It's all freelance stuff and you can turn off the app when ever you need too.

Other places like pizza delivery require you to be on a set schedule, which is why most commands frown on jobs like that.

You cannot get fired when you're not an employee.

6
Former_RM2 6 points ago +6 / -0

Not only is it not illegal, but as far as I'm aware, nobody has challenged the validity of of these clauses in an employment contract. I'm not saying a tort judge will decide in the employee's favor, but they might. We just don't know.

1
FuckChinaRaw 1 point ago +1 / -0

Unlikely that anyone will sue to keep their job at Uber, Lyft, or Dominos. These clauses are just to keep the companies from getting sued if an employee does use a weapon on the job.

58
Spookyfishlizard 58 points ago +58 / -0

They better be careful with that “we prohibit” language. Uber drivers are independent contractors. Uber is pretty limited in what they can tell you you can and cannot have in your own vehicle. They like to play both sides; get the tax advantage of calling drivers independent contractors while treating them like employees. Uber is a filthy company. All gig app companies are filthy crooks.

17
DoesItWorkAlready 17 points ago +17 / -0

I like the smell of "mass arbitration" in the morning, which Uber has already suffered from.

Mass arbitration takes advantage of the asymmetry under CA and JAAMS rules where the individual pays $250 to file an arbitration and the company pays $10,000 to defend it.

Multiply that by a lot of drivers, Patreon patrons, etc, it can get quite interesting.

11

I read the language. Seems to me the only thing enforceable is the company that says don't have your gun with you on company property. Even then they have to find it.

5
BirchTBarlow 5 points ago +5 / -0

Company property? He's driving his own car.

2
CuomoisaMassMurderer 2 points ago +2 / -0

Right! That was my point. Company property would only pertain like if he has to go to the office for some reason. Other than that they won't even try to enforce this. The only way they'd ever find out somebody was packing is a situation like this where they have to defend themselves, or if someone commits a crime which I think they'd at least make sure they aren't working at the time.

Anybody defending themselves could cough up $250 to start the arbitration process over wrongful termination, and the company has to pay $10,000 to defend themselves. I think they'd kiss ass to settle before going to arbitration. Meaning their silly rule is entirely unenforceable; it's just optics.

5
CuomoisaMassMurderer 5 points ago +5 / -0

What did they get banned for?

5

Mostly local politics involving local taxis and city funded transportation. In the end they allowed Uber to work there.

3
CuomoisaMassMurderer 3 points ago +3 / -0

I read the language. It seems to me that the only enforcement they can do is the one company that says you can't have your gun with you on company property. Even then they have to find it.

7
Regardless 7 points ago +7 / -0

His car wasn’t their property while he was working for them.

7
CuomoisaMassMurderer 7 points ago +7 / -0

Right! Exactly my point. It would be funny af if the companies got sued over this; the only possible scenario I can envision is they fire someone for having their own gun in their own car. Apparently there's an arbitration clause where the employee pays $250 and the company pays $10,000 to defend.

The company would never make up that $10,000. They would kiss ass, rehire and whatever else they had to do. The company makes money off that driver.

He’s also lucky he’s in the “right” state, otherwise what should be no charges could turn into a long drawn out money pit for somebody who did nothing wrong. Look at MO with the McClaskey’s and the Michael Brown case still isn’t over. Officer isn’t facing any charges but I can’t imagine having to sleep with this weight of potential prosecution for 6 years.

5
AlohaSnackbar 5 points ago +5 / -0

They become long, drawn out issues because far too few of us participate in juries. Not because we get weeded out, but because, generally speaking, we got shit to do and the brains to get out of a jury to do it.

Instead we ought to be using our brains to take back the local judiciary. Imagine a world where every non-violent drug case ended in a hung jury. Every real self defense case ended in a hung jury. And so forth and so on.

The lawyers would quit waiving their clients right to a speedy trial, instead demanding it, so they could get in on some of that sweet, sweet nullification.

Austin shot first!!! U can hear the AK-47 go off 3 times before the soldier fires a shot in the video

21
Oback_Barama 21 points ago +21 / -0

Listening to the video you can hear 5 shots from one gun then three from a different gun. I initially thought it was 5 from the AK and then 3 from a 9mm. According to this soldier it was 5 from his handgun and then 3 from a gun in the crowd. The second gun certainly wasn’t as loud as the handgun. Maybe a little 22 pistol maybe?

6
CuomoisaMassMurderer 6 points ago +6 / -0

There's also a fourth shot. Amazing that the "peaceful protester" shooting 3 or 4 rounds at a fleeing vehicle isn't charged? Wtf

3
FuckRioters 3 points ago +3 / -0

It sounds like there aren't charges yet.

The person who shot at the fleeing vehicle obviously lacked proper awareness and decision making ability to operate a firearm. They didn't see the incident that lead to the shooting, and didn't even know if the vehicle was involved in the shooting. All they knew/saw was the vehicle fleeing after gunshots were heard. They could have also easily hit bystanders.

1
CuomoisaMassMurderer 1 point ago +1 / -0

I agree completely. Letting criminals go is pissing me off. Any one of them might show up to face charges on the honor system, but especially without bail many are NOT likely to. With roughly 30 million illegals we don't have resources to impose or maintain rule of law. We the Pepe fixing this is neither 1776 nor Civil War, but whatever you call doing patriot shit is getting more necessary and imminent.

6
NormaJeanRocks 6 points ago +6 / -0

Its just weird because you would think the shots coming from inside the car would silence it even more, unless that is what is making it sound like a rifle? Or maybe when he shot he had his gun all the way out the window, dont know.

5
CuomoisaMassMurderer 5 points ago +5 / -0

That was what people were initially saying. It turned out the rifle dude never fired.

7
Rob_Belmonte 7 points ago +7 / -0

Of course, pointing a rifle (or any firearm) at someone is in the very least aggravated assault. And in any self-defense case is legal means for the victim to use lethal force in self-defense.

Ask yourself, if you pointed a rifle at the police and didn't fire it, just pointed it at them, what would happen next?

1
CuomoisaMassMurderer 1 point ago +1 / -0

So McCloskeys in St Louis were legitimately aggravated assault? Fear of death or severe bodily injury is the standard for use of lethal force, in WI that also pertains to defending someone else. How can you NOT have that fear when the horde is 40' from your house?

Anybody without that fear since 5/26 is being reckless. They proved they were out for blood. They proved they want us dead.

Does NOT sound like 2 pistols! Sounds like AK followed by pistol. Followed by an isolated shot. 9 total

8
Alpinix 8 points ago +8 / -0

Article states that the protesters surrounded Daniel Perry's car. Garrett Foster asked Perry to lower his window. He did and then Foster raised his AK and pointed it at Perry. At that point, fearing for his life, Perry fired 5 shots at Foster hitting him multiple times. The three shots you hear after that are from another protester firing at Perry's vehicle. Perry immediately dialed 911 and reported what happened. Police talked with both Perry and the protester who shot at Perry's vehicle (I'm assuming separately) and released them both.

3
CuomoisaMassMurderer 3 points ago +3 / -0

There's also another shot moments later. I don;t see why the rioter shooting at a fleeing car isn't charged.

2
Alpinix 2 points ago +2 / -0

I agree. It is far from responsible to shoot toward a car when you can't possibly know the context of what just happened. The protester's life was in no danger whatsoever and he shot three rounds toward a crowded area. Definitely should have been arrested.

4

4
Deplora 4 points ago +4 / -0

Both the driver and the "protester" who fired at the car as it departed the scene, were interviewed by police, had the guns they used taken as evidence, and were promptly released. No information yet on what the "protester" told police as plausible justification for firing at a moving car in a crowded situation, when the driver had done nothing but fire in self-defense.

4
CuomoisaMassMurderer 4 points ago +4 / -0

I don;t understand why this second shooter wasn't charged for shooting at a fleeing car. And the final, 9th shot, is omitted.

3
Deplora 3 points ago +3 / -0

He must have said something that passed for plausible justification. But it's hard to imagine what. Perhaps claiming that he was trying to stop the car because he thought it was trying to hit other "protesters", even though firing in that situation posed a huge risk of unintentionally hitting another person (other than the driver) and a very low likelihood of stopping the car in a way that would reduce harm to people in its path. Maybe he admitted that in hindsight it was a bad decision, but at the time, he'd thought the driver had fired offensively rather than defensively, and was trying to drive offensively into "protesters". And he could still be charged.

1
CuomoisaMassMurderer 1 point ago +1 / -0

Well I hope he's charged! Seems like a lost cause, it being Austin? That's the place to watch this weekend, see if they set up a CHOP in front of APD HQ, or if the real murderers make their move. Shit is escalating ...

1
Deplora 1 point ago +1 / -0

I never saw any report claiming either of the men was ever "in custody". They were interviewed by police and then released. That's not "in custody". The driver called 911 himself to report the shooting, and went to police voluntarily. The other shooter probably went voluntarily too, as there was never any announcement that police were looking for him.

Read the article. Soyboy never fired the AK. He just menaced with it and that’s was all that it takes to justify a lethal response.

First series of shots was the patriot. Must have been a larger caliber handgun because it was thunderous. Did the job in any case.

Second quieter round was the terrorist rioter. Probably a 22.

I’ll have to eat my hat though I really thought the first round was from that AK. It was way louder than the second series.

4
Mexicola1976 4 points ago +4 / -0

4

I avoid downtown like the plague now. Austin is so woke and Election Day can't get here fast enough for me to vote for Trump and to vote against the needless, expensive propositions that will probably also appear on the ballot.

poopdeck 6 points ago +7 / -1

Austin is well on its way to the next Portland/Seattle soyboysimpcucktown

2
FuckRioters 2 points ago +2 / -0

Portland is MUCH worse than Austin by far; there was some comparatively small worrying activity the first 1-2 weeks, but since then it's only a small annoying crowd that you wouldn't even know existed unless you happen to be driving downtown late at night right where the protesters hang out, or pay attention to local activities closely.

Austin resident here. Not even close buddy. We Texans make sure of that

It's already in the budget to blow up the APD. Expect it to develop it's own CHAZ/CHOP this weekend, maybe right in front of the APD HQ. Abbott is scared of antifa.

11
AtariArtist 11 points ago +13 / -2

Headline is backwards. The guy who was peacefully blown the fuck away is on the left. The headline makes it seem like the winner was 'the guy on the left' or 'the first picture'.

It wasn't.

Didn't realize uber and lyft had no weapons policies. Still not sure how those guys have shit like that and get away without making drivers w2 employees.

assault rifle

How did this idiot afford a class 3 stamp?

Oh... You mean both the lawyer and news are fucking retarded and don't know what an assault rifle is?

Also had to lol at uber and Lyft saying that not even riders can conceal carry. Like. Fuck off. You going to make the driver pat down and wand everyone?

2
fskfsk 2 points ago +2 / -0

How did this idiot afford a class 3 stamp?

The bosses at BLM/Antifa are handing out weapons.

-1
MajJamesMcFarlane -1 points ago +1 / -2

Not even they got the money for that many full auto rifles. Not to mention the very low supply

fskfsk 0 points ago +1 / -1

Their budget is billions.

Buy a few guns, give them to idiots, and the stories write themselves.

Sgt. Perry should stay frosty. God protect him.

6
MagaKagBTW 6 points ago +6 / -0

Article says he took a right turn into a group of people protesting police brutality. Wrong!!! He took a turn onto a street the was illegally filled with protestors. They act like he disrupted a protest when it was the protestors disrupting traffic.

3
OhLollyLollyPop 3 points ago +3 / -0

He was in a line of cars in that street, not randomly trying to plow through alone.

6
RockFlagAndEagle2020 6 points ago +6 / -0

Isn't the first rule of gun safety not to point your gun at something unless you intend to kill it? Looks like Garrett thought it would be a fun game to threaten others. I guess he decided to threaten the wrong person. If you walk up to someone's car window brandishing a gun and pointing it at them don't be shocked when you get shot dead by a better man.

2
SomaticallySpeaking 2 points ago +2 / -0

...IN TEXAS. /sighs in Darwin

I can't know, but I suspect his last thought was probably remembering what he had said earlier that day, about all the pussies who wouldn't do anything.

Garret was acting like a thug harassing somebody just trying making a living.

5
bixnood 5 points ago +5 / -0

It's looking like the police are angling towards declaring it a justified accidental shooting. Will allow them to dismiss the incident and avoid political fallout. Then, all of the rioters/gun people will corroborate in the various blogs about gun safety and decorum.

5
prancie 5 points ago +5 / -0

That answers how/why his window was lowered, and there is proof that that Garrett pointed his weapon at Perry, photographic evidence. If it were me, I'd have shot him too. There is no reason to rush vehicles simply trying to negotiate an intersection, apparently we are becoming south africa.

I'd even suggest it's possible that Foster never fired a shot in his entire life. Considering Foster's actions, and the person in the crowd that shot at a car (despite lacking any context), this seems to follow a pattern of "protesters" feeling an unrealistic sense of power, where things like laws and acting like a normal human being don't apply to them

exactly. If he had fired a shot then the motorist would be dead. If someone aims a weapon at you you don't have to predict what they are going to do next, you get to assume they plan to pull the trigger.

5
Covfefe_Crusader 5 points ago +5 / -0

That second shooter that was under no threat at all and fired at a fleeing vehicle needs to be prosecuted to the fullest extent of the law.

4
Meatbank84 4 points ago +4 / -0

There is evidence what the driver/shooter said is true. There is a picture of Garrett with his rifle drawn and elbow up indicating he is pointing it at the car. This man has nothing to fear.

Both Uber and Lyft have strict no-firearm policies for both drivers and riders. I say better to get fired by your dipsh!t employer than fired at by a lunatic.

2
CuomoisaMassMurderer 2 points ago +2 / -0

I don't think they can enforce anything beyond the one that says don't carry on company property. It wold be funny af though to sue for wrongful termination, lol

1
RacistElkStatue 1 point ago +1 / -0

Yep, worst they can do is fire you. And for a passenger, if you conceal, they won't know anyway

Toll: PAID

The situation that ruins your life is most often brought by those you hang around with. He ran with a toxic gf and he died as a result.

Your social circle matters. In instances we see over and over, people’s lives are ruined by the ideas their company keeps.

Your post gave me a second of empathy for the soyboy.

Maybe he's just a poor bastard who somehow got into a relationship with that disabled jogger black woman. He felt so bad about her that he thought he should do something in BLM for her.

2
CuomoisaMassMurderer 2 points ago +2 / -0

Ok now that that second has passed - dead guy was a grown man. He knew better.

0
Italians_Invented_2A 0 points ago +2 / -2

You're right. He had a fucking AK after all.

1
CuomoisaMassMurderer 1 point ago +1 / -0

Even without any gun, any driver in that situation is justified in using lethal force. Driving away is better IMHO, but the AK at point blank range pointing straight at him clarified to the driver what his target should be.

It's one thing to open carry at a "protest" , but stopping cars in the road and approaching them with a rifle pointed. I mean what the fuck do you think is going to happen. Too bad his skank whore wife is probably going to be rich from go fund me bullshit.
