The person who shot at the fleeing vehicle obviously lacked proper awareness and decision making ability to operate a firearm. They didn't see the incident that lead to the shooting, and didn't even know if the vehicle was involved in the shooting. All they knew/saw was the vehicle fleeing after gunshots were heard. They could have also easily hit bystanders.

Perry immediately dialed 911 and reported what happened. Police talked with both Perry and the protester who shot at Perry's vehicle (I'm assuming separately) and released them both.

I never saw any report claiming either of the men was ever "in custody". They were interviewed by police and then released. That's not "in custody". The driver called 911 himself to report the shooting, and went to police voluntarily. The other shooter probably went voluntarily too, as there was never any announcement that police were looking for him.

If the article / unconfirmed driver account is to be believed. The rioter pointed his assault rifle at the car/ driver and the driver fired 5 shots at the rioter. The other 3 shots were other rioters shooting at the car.
There's also another shot, moments later. I don;t see why the "peaceful protester" firing 3 or 4 times at a fleeing car isn't charged?

Article states that the protesters surrounded Daniel Perry's car. Garrett Foster asked Perry to lower his window. He did and then Foster raised his AK and pointed it at Perry. At that point, fearing for his life, Perry fired 5 shots at Foster hitting him multiple times. The three shots you hear after that are from another protester firing at Perry's vehicle. Perry immediately dialed 911 and reported what happened. Police talked with both Perry and the protester who shot at Perry's vehicle (I'm assuming separately) and released them both.

He must have said something that passed for plausible justification. But it's hard to imagine what. Perhaps claiming that he was trying to stop the car because he thought it was trying to hit other "protesters", even though firing in that situation posed a huge risk of unintentionally hitting another person (other than the driver) and a very low likelihood of stopping the car in a way that would reduce harm to people in its path. Maybe he admitted that in hindsight it was a bad decision, but at the time, he'd thought the driver had fired offensively rather than defensively, and was trying to drive offensively into "protesters". And he could still be charged.

I never saw any report claiming either of the men was ever "in custody". They were interviewed by police and then released. That's not "in custody". The driver called 911 himself to report the shooting, and went to police voluntarily. The other shooter probably went voluntarily too, as there was never any announcement that police were looking for him.

Even without any gun, any driver in that situation is justified in using lethal force. Driving away is better IMHO, but the AK at point blank range pointing straight at him clarified to the driver what his target should be.
