Good afternoon and thank you for your email. The Metropolitan Police Department (MPD) respects the right of all individuals or groups to peacefully assemble as their First Amendment right and we remain impartial as to the underlying cause or motive of any group. In the matter at hand, the Special Operations Division Planning Section informed the organizer for Students for Life America well ahead of time that painting of the street or public space would not be permitted by MPD. The District Department of Transportation reviews requests for marking of public space and issue permits at their discretion.
The MPD permit was issued for an assembly only and did not include language permitting the chalking or otherwise marking/defacing the sidewalk. Further, prior to authorizing the arrests, the lieutenant on site issued multiple warnings to the two individuals writing on the sidewalk that doing so was in violation of D.C. Code § 22–3312.01 “Defacing public or private property.”
I’d also like to point out that since the civil unrest began in late May, hundreds of arrests have been made for various violations, to include Defacing public or private property.
I realize that on the surface these arrests seem unwarranted but hope the above information provides an understanding of our position.
