State's can run their ballot however they want. That's the facts. And changing it would require a Constitutional Congress. You don't want that - and it would take years to slog through one, because you KNOW the dems would be all about "While we're here, let's just make some small changes to #2...."
Interestingly, while Nevada is controlled by Dems, they have "none of the above" on their ballot. And the state is split down the middle in terms of voters.
But, they lost their electors in the electoral college, and voted for Hillary. i suspect they still have that on lockdown.

I'm all about state's rights, but this could be argued under interstate commerce, or the federal government protecting the union.

They should be suing in Michigan too. I think they only thing that got so far is they can't count ballots that aren't in by end of election day.
