It took 14 months but we lost the battle in AZ Superior Court against our HOA regarding our Trump 2020 flag. Judge Robert Olson just happens to be recent Treasurer for Arizona Democrat Party. Next step AZ Court of Appeals.

Depends on the HOA. Some can be insufferable assholes, most are just fine. They can prevent animal hoarders, unlicensed car repair shops, mentally ill asshole neighbors painting their house Throbbing Dildo Pink, and other annoyances from ever getting started, or at least deal with them expeditiously when someone manages initially to hide the problem.

I knew a shithead vegan Canadian who started an "animal shelter" in a formerly peaceful neighborhood. He rented a house (couldn't afford to actually buy one) and built around fifty cages all over the lawn to house random stray dogs that people had dumped, then packed all the cages full. The smell was horrible, not to mention the constant noise from all of these ill-tempered animals that had been forced together. There wasn't any law against it where he was, so his neighbors basically paid off the cops to make shit up, haul the dogs off, and gas them all. Then they told his landlord to cut the crap or they'd burn the house down, and ran the shithead out of town.

Closer to home, there was exactly one house on my block that the owner had put into the "Section 8" program. He'd done it years before I bought my place, and the tenant he had in there when I moved into the neighborhood was a harmless hippie pothead. Unfortunately, the pothead got sick of the landlord refusing to do repairs on things like having a working heating system in winter. So the pothead moved out and a single mom with multiple "if Obama had a herd of sons" by different fathers moved in. They brought all their gang buddies into the neighborhood resulting in some scumbag trying to kick in my door at 3am one night. I don't know if an HOA can legally block "Section 8" rentals, but they can ban ALL rentals, which works just fine, or put very strict restrictions on rentals (like at most 25% of properties in the neighborhood, with fees attached to the permits, and revocation abilities) so that "Section 8" becomes untenable.

Screaming "freedom!!!" is great when it isn't your property value taking a nosedive because some complete fucktard moved in next door and started a pitbull rescue.

HOAs are not the problem, they are a symptom. The reason HOAs even exist is because homeowners ended up breaking the social code and doing dump things like hoarding, leaving ugly eye sore like broken down rust buckets in their yards. If people kept up house maintenance and understood what affects housing value (which should be a shared concern), we wouldn’t even be discussing this.

It depends. You do need to enough about it going in. My parents old neighborhood was dope. Community projects together (bake sales, pressure washing the road, adoptamile outside the neighborhood, canned food drives, etc.), community yards sales, they close the neighborhood during Halloween and only allow trick-or-treating inside the neighborhood and have a hayride. Dues go to decorations, yard maintenance for empty houses, mailbox paint, etc. The only downside I saw was that of you have an outside building, the brick had to match the house.

If you could find a community of like-minded folks, I think HOAs can be good.

We tried signs too and the cease and desist letters came then I thought about it, bought a Trump 2020 sun screen for the car and back the car in the driveway. Not a damn thing they can do. Assuming you have read the HOA bylaws, there are always loopholes ready to be taken advantage of.

Most HOAs have rules specifying what colors are allowed for homes in a neighborhood. You may not be allowed to paint your house with a Stars and Strip es, but you may be able to paint a Trump banner using the authorized colors.

There's probably a rule about abandoned cars in your driveway. Of course with everyone always home that one's hard to enforce right now.

You should get one of those lifted trucks that people like to fly flags out of the back of. You could have several flags attached to the truck and it would probably be within the rules.

Take it for a drive around the neighborhood every couple of days as proof that it's not abandoned and also advertising.

You have to know the rules and exactly how to fiddle with them, but it’s usually possible to get the president position and make the rules ridiculous. My favorite would be “only the HOA President can call meetings” “issues may only be addressed in official meetings” “new positions may only be nominated at official meetings.” “Official meetings require 100% membership attendance for quorum.” Then, I resign.

If it’s a legal HOA, they must follow impossible rules to have any teeth.

2 years ago we tried. There were 3 of the 5 seats vacant. We got three new good people elected. Next day property manager sent out a recall letter to all homeowners recalling the three. AZ law requires a recall to start with a petition signed by minimum 25% of homeowners. She skipped that. So I took the HOA to court and won. Then the property manager declared that there was actually a tie for third and the only recourse was to put both on the board. Need a majority to get rid of her and we just couldn't do it. After that, I got the summons to Superior Court for my flag.

I got deep into HOA issues. The way I did it was to proxy hoard and bring >50% of the neighborhood's votes via proxy and take over the board. I then fired the existing attorney, replaced him, and then got opinions issued based on interpretations of the declarations that were more favorable to me. The other board members eventually quit so I had total control. The law favors the board and the HOA, so if you live in one, you absolutely need to be on the board with allies.

Lawyers were largely a dead end when I wasn't on the board. They'd waste money or they weren't well versed in community association law. Taking over the board is the only true way to get rid of tyrants -- going door to door and getting proxies is the way you fight it.

That's a good point. We need property tax reform. I was reading how back in 1796 the state of Delaware didn't tax properties directly but instead taxed income from a property, if applicable. That makes sense to me.

Judges should have no political ties either way, they should be politically neutral and focused only on applying the rules of law that is not tainted by viewing any case through a political lense. I would go so far to say that they should not be allowed to vote/make political donations or endorsements and there should be a regulatory body to hunt out the bad apples

Ask for the meeting minutes, the financials, etc. Make sure you put an HOA contingency in the buyer's contract if you're buying into an HOA.

I've always heard that HOA prevails in court no matter what. That they function almost like their own government. You either follow their rules or you pay the fine, get a lien put on your home, etc. This is why I will never buy a home in an HOA.

Get teams to go in overnight and paint big ass TRUMP 2020 on the roads in the HOA. Roads are city owned and then the HOA has no authority over them. Sure, the city might remove them but in most large cities that takes months.

You could also “chalk” this slogan on your driveway.

Buy some drones and hang a Trump 2020 flag from it. Then have it hover and pit it on auto pilot. When batteries run low use other drone while charging. Only needs to go up enough to keep flag from dragging on ground. Since not high enough HOA can’t say privacy is being invaded.

Put “Christmas” lights on house using Trump 2020 in them, lights are legal.

That is why we are off to Arizona Court of Appeals. I am 75, owned a lot of homes in several states. First time lucky enough to get an HOA. As I said above, first 10 years were great. Then new property manager and it all went to Hell in a hand basket. Had I only known.
