The old rule was created in 2016 (while Obama was President), but before he left office a federal court issued a nationwide injunction against enforcing the rule on the basis that it changed the meaning of sex in the statute. A second federal court later agreed, and on October 15, 2019, the first federal court issued a final judgment, vacated and remanded the gender identity provisions as UNLAWFUL.
Because of that, the old rule was never enforced. As a matter of law it NEVER EXISTED.
Anyone who says the Trump administration rolled back protections for transgendered people is either lying or an idiot. Or both.
