Technically correct. It is perfectly legal to says the words "there are only two genders" in that sequence in a public or private area. However, misgendering IS illegal, so if someone identified as xiggywiggygender, and you say they are not xiggywiggygender but rather male or female, you can be subject to high fines, which is left unpaid, can lead to prison time. The two genders in the initial phrase could be Male and Xiggywiggygender, so the declaration is fine in the vague term, it doesn't misgender anyone specifically.
