It’s a plan, but it’s a dumb plan. Here’s why.

The Electoral College will meet on December 14. If some states decide not to send electors, that’s their problem. If they don’t meet (DC is more likely to be in smolders than this happening) or no candidate got an absolute majority of the votes cast (which isn’t necessarily 270), the House chooses the President out of the top three candidates with the most votes. This is done with each state having one vote, regardless of how many Electors they have. The Senate chooses the Vice President with one vote per Senator. Trump/Pence is a near certainty in this scenario.

This is all explicitly laid out in the Constitution (Article II and Amendments XII and XX), it’s unclear if even RBG could interpret anything else

IF we dont know who won though how do we vote with the people that were supposed to have won?
