I think you're missing the point of this question. He's wondering why the prosecutors are getting away picking and choosing who the law applies to. There must be some recourse in the system to hold a prosecutor accountable when they refuse to uphold the law.

Imagine for example, that a prosecutor simply refuses to prosecute rape. He always drop the charges against rape. Such a prosecutor has effectively legalized rape-- is that even legal for a prosecutor to do?

No, of course it isn’t. But the checks on it in our system are legal and politically controlled. When the entire legal and local political establishment are against all law, we have rebellion and not any mere legal matter.
