The issue at hand: if the law does not prescribe minimum sentencing for heterosexual crimes involving same ages, they claim it shouldn't for gay people.
Personally, I think California needs to make their age of consent laws less overall retarded:
California laws have this state of idiocy where their age of consent is 18 and ANY sex under that age is considered in violation of age of consent. (No minimum age under which one can get married with parental approval though)
They have no 'Romeo and Juliet' type bracket exceptions to accommodate relations of young people with each other. Just a hard cut-off
They should lower age of consent to 16 and most of their silly cases go away. At that point nothing wrong with straightening out proper penalties for offenders who prey on younger people.
Instead their legislature aims at unrealistic human standards, judges are carving out exceptions to try and prevent this stupid legislation from ruining lives and real predators slipping through the cracks created.
Exactly. Pedophilia is not a teenager of 14-17. It is a prepubescent child. 14-17 is statutory rape. And even the idea that a 17 year old doesn’t understand how to consent is ridiculous. This difference between consent and pedophilia is like Me Too conflating sexual harassment with sexual assault. The difference is dangerous and pisses me off. People, please don’t try and act like an adult having sex with a 16 yr old is the same as a 6 year old. It’s harmful and overly modern to conflate the two. I’m not saying I support this bill but it’s a difference we should be clear on. Or else the real problem that destroys children physically, psychologically, and spiritually will become acceptable somehow.
