It isn't the same. The whole "not baking a cake" involved performing labor. The MasterCakes baker didn't refuse gay people the right to shop in his store, he just wouldn't bake a cake that sent a specific message. If they had asked for a cake that had no message on it, there likely wouldn't have been a problem.
