First of all, wow my phone tried to autocorrect “gun” to “fun”.

Secondly, my state has a “stand your ground” law, but requires that you not “use excessive force” unless you can prove your life was in danger.

I saw a video tonight of a mob approaching/surrounding a guy with a gun, and they didn’t touch him, though at any moment they could’ve jumped him and beaten/killed him. Would responding with lethal force be justified in that situation?

Excessive force tends to be a sliding scale depending on the situation.

Mag dump into a lone perp? Probably excessive.

Mag dump because you're surrounded by an angry murderous mob? Not so much.

I am not a lawyer and many of these things very from state to state. Generally speaking, however, your life does not have to be in danger. You have to have a reasonable fear that your life is in danger. If someone is aggressively charging you and shouting "I'm gonna kick your ass" that may be enough. Check with a lawyer in your local state, however, for specifics.

Depends. Lots of factors. Even in clear cut cases charges get brought. Sometimes murderers get away with it.

Its a gamble, which is why you should only use lethal force if your life is in danger. The risk of death always outweighs potential legal trouble.

but couldnt you say the shooter was in a place of nuisance thus making him criminally liable?
