That's false. It is absolutely the duty of the AG to decide. You do not bring charges against people unless you have the evidence to convince a jury beyond a reasonable doubt.

The DA also charged him with fleeing the state when he went home that night. They are clearly appealing to the mob with such a bogus charge.
