Someone off camera shot a pistol into the air (this was confirmed by the NYT coverage of the events) and when this happened, Joseph "The Sex Offender" Rosenbaum went and tried to grab his gun from him, but was shot in the head. You can see Kyle backing up into the cars, then come around the other end after shooting him. He seems shocked and horrified at just killing him, then runs away.
Yeah, at first I thought he was holding his hand up to his head in a sort of "oh fuck!" moment, but hes on his cellphone. Its very clear hes innocent, all charges should be dropped and I would seek prosecution against the democrat rat who decided to charge him in the first place.
