He was charging, and our hero had nowhere left to escape to. Although the entry point of the bullet suggests someone off to the right of the screen may have shot him, not Kyle. The bullet went in the right side, not the front of his head. This makes no sense for Kyle to have been the shooter. He might take the blame anyway.
