The Felony murder rule usually only applies to BARRK violations (Burglary Arson Robbery Rape Kidnapping) some states have expanded it but I don't think it applies here. Plus even if it did they would have to establish his victims weren't commies and therefore human

hahahahahahahahahahahaha lawyers that lose cases still get paid, trust me I know, it is not about the merit it is about the attention and if the client can pay. And in this case even with a failure WaPo, NYT, NBC, CNN and many others are going to hold them up as heroes fighting racism, so much so I wouldn't be surprised if they did it pro bono to make a fortune on the back end
The last part was the most pertinent, as even if they were sniveling and crying for their lives, it would be required to put them out of our misery. Known as the compassionate rule. I hope that would appease the rable.
Wisc. Stat. Sec. 940.03 is their version. Lots of criss references, but it dies rooe in certain weapons possession/uses, among other things.
At any rate, at least some of us discuss this out of worry and/or curiosity, not trolling.
But I agree re the commie point.
the only one that could apply is 940.19 Battery; substantial battery; aggravated battery. and it goes back to intent, the whole idea of the felony murder rule is to eliminate the intent requirement in first degree murder, you can't eliminate intent with a law that requires intent, and intent in this case is going to be very hard to prove
I agree. I think the DA will try to “prove” the headshot was a predicate felony, rendering the second kill shot as murder without regard to actual self-defense.
The first shot footage isn’t as clear, so that will be what he hangs his hat on (or just blatant perjury from commies).
I wouldn’t convict. I hope his jury won’t either (or the judge dismissed with prejudice).
I saw the first shot footage, it is pretty similar to the second fight, I think crowder posted it on youtube, and the idea of if someone is still approaching you when they see you have a gun, and used it, is way more than is necessary to prove you were acting in self defense, I always give the advice, if someone enters your home shout out "I have a gun" because if they proceed after that you are well within your rights to shoot them, in any state
