And, Kyle's back was turned (he was running away from Pedo Rosenbaum) when that first shot rang out. It's more than reasonably for Kyle to have thought that he was being fired at (and missed) by the guy that was chasing him.

Ironically, the dude that fired the shot was seen earlier with Pedo Rosenbaum threatening the group Kyle was with. He is exactly what you thought he would --a scuzzy, dirty, unkempt loser.
