My first thought in all of this was Kyle’s lawyers should be pressing for a speedy trial. Now that he’s arrested they have 30 days to indict and 30 days after that to take it to trial. There’s not a prosecutor on Earth that wants to take a case to trial that fast.
Honestly, I don't think they intended to follow through with prosecution and just charged him to appease the mob. Because if you read the charges, it basically outlines a case of self-defense.
What they didn't count on was the kid getting a prime legal defense like this.
Agree they didn’t expect Lin Wood to round up a prime legal posse. Plus charging first degree murder was definitely a ploy to try to push for a plea deal.
But they should still push for a speedy trial. Especially because none of the lawyers regularly practice in that jurisdiction. The main reason they usually don’t is to maintain the normal relationships with prosecutors and judges they’re going to see again sometime. These lawyers don’t have that problem
The right to a speedy trial is protected by the 6th Amendment to the Constitution.
I'm pretty sure Lin knows this. There are lawyers and then there are LAWYERS. The DA would be foolish to play games here.
